Existing law prohibits discrimination and harassment in employment based on certain factors, including race, religious creed, gender, or sex. Existing law prohibits discharging or discriminating against a person who has opposed any practices prohibited by these provisions or has filed a complaint, testified, or assisted in any proceeding for a violation of these provisions.
This bill would impose joint and several liability on an employee of an entity subject to these provisions for violating, with specified intent, personal liability on specified employees for certain actions in connection with violating the prohibition against discharging or discriminating against a person who has opposed any practices prohibited by these provisions or has filed a complaint, testified, or assisted in any proceeding for a violation, regardless of whether the employer or covered entity knew or should have known of the conduct. violation.
