SB 1283: Mental Health Services Act.

  • Session Year: 2021-2022
  • House: Senate
  • Latest Version Date: 2022-03-16
Version:

Existing law, the Mental Health Services Act (MHSA), an initiative measure enacted by the voters as Proposition 63 at the November 2, 2004, statewide general election, establishes the continuously appropriated Mental Health Services Fund to fund various county mental health programs and requires counties to spend those funds on mental health services, as specified. The MHSA also establishes the Mental Health Services Oversight and Accountability Commission to oversee the administration of various parts of the act. Existing law authorizes counties to establish a prudent reserve for their Local Mental Health Services Fund, not to exceed 33% of the average community services and support revenue received for the preceding 5 years.

This bill would state the intent of the Legislature to enact legislation that would amend the MHSA to provide the counties with more flexibility in shifting county MHSA money between programs and to include additional allowable services, including addiction treatment, case management, employment services, peer support, crisis intervention and stabilization, and family unification. The bill would state the further intent of the Legislature that this amendment should add county reporting requirements relating to how many persons who are homeless and have serious mental illness were served by the counties, along with treatment outcome data.

This bill, instead, would limit the counties prudent reserve to 30% of the average community services and support revenue received for the preceding 5 years.
