SB 383 is one of the bills carried by the chairs of the Appropriations Committee each year to provide appropriation authority for legal judgments and settlements approved by the Department of Justice and Department of Finance.

This urgency Bill appropriates approximately 6.8 million from the General Fund to DOJ for the payment of the following claims against the state Wetlands Preservation foundation versus Department of Water Resources, California DUI Lawyers Association versus Department of Motor Vehicles. These judgments and settlements are to pay for the prevailing party's attorneys fees and costs, and they are binding state obligations. Any funds appropriated in excess of the amounts required for the claims will revert to the General Fund.

Thank you for allowing me to testify today. This is our annual Bill to provide appropriations for legal settlements against the state wherein the state was represented by the Attorney General.

SB 383 would appropriate 6,000,777, $73 from the General Fund to the Attorney General for the payment of claims, settlements and judgments arising from cases against the Department of Water Resources and the Department of Motor Vehicles. From the Bay Area to the Central Valley, we know that it's important to have strong and healthy, vibrant African American communities. The reparations interim report has allowed for a strong start for redress and repair. And so we do believe that the reparations task force needs more time in order to move so that they can come up with recommendations, bills, and to extend how they oversee the process in the future. The underlying program you're looking at here is a food safety program that was passed over a decade ago by then Senator Alex Padilla. What we're talking about here in this bill is at the time the bill was passed over a decade ago, it did not create an employer mandate in terms of the individual investment on an employee's behalf to get the training and requirement in SB 476 that requires restaurants to pay for the time of the training.

So to get to the fiscal issues at the time, there were five employee protective measures that were put into the bill. One was that the training is the property of the employee. It's portable from job to job, region to region, county to county. It lasts for three years. The employees have a choice of the provider that they can use for the food safety training.

There's an open market with lots of choices, and most importantly, affordability was written into the statute that food safety training be provided for $15 or less. And so what we're talking about here is an individual investment by an employee versus 476, shifting the cost burden onto the employer. And one thing I want to make a distinction here is on an individual basis, given the law right now, it's about $5 a year for an employee to keep up this training.

When you look at the industry and it's super labor intensive and you magnify all those costs for every employee across every neighborhood restaurant, it creates massive costs and departs from the original underlying loss. So the financial impact here is that at this time, any added cost to restaurants as we crawl out from the pandemic, losses are going to cause us to shrink back hiring, and that will inevitably lead to lower sales tax revenue at the state and local level. We were proud before the pandemic to be one of the leaders in state and local tax generators, and we want to get back to that. So that is the appropriations angle that we would provide to you, as well as the analysis that staff pointed out in terms of the state costs and the added state and local reimbursements that would be required. This bill will allow K-12 school districts to apply signs on the rear of their electric school buses, identifying them as zero-emission vehicles. The bill also authorizes CHP to issue guidelines governing the size and placement of the signage as the state moves towards a carbon-free future. The electrification of the state's massive K-12 school bus fleet is a significant step in achieving our climate goals.

California has an estimated fleet of 23800 school buses, of which only 2% are either hybrid or fully electric. Students who ride diesel-powered school buses are at higher risk for allergies, academic declines, asthma, heart issues, and cancer. Transitioning our fleet is not just a matter of achieving our climate goals, but also a matter of our children's health. Clear labeling of electric school buses allows communities to see the impact of their hard-earned tax dollars as we replace our aging diesel fleet.

Identifying our electric school buses not only gives families the peace of mind that their children aren't being exposed to further exhaust fumes, but also highlights our important work as we transition from fossil fuels to a carbon-free future, and also creates accountability as parents learn that this is an option.
