Senate Standing Committee on Appropriations
- Anthony Portantino
Person
Appropriations will come to order as a Subcommitee. We do not have a quorum, but we will come to order anyway. For individuals wishing to provide public comment through the teleconference line, the teleconference participant number is 877-226-8163. That is 877-226-8163 and the access code is 1147276, 1147276. We're holding our Committee hearing in the O Street Building in room 2200 where all the action is happening this fine morning. We will establish a quorum when we have one.
- Anthony Portantino
Person
We have 60 bills on the agenda, one of which is eligible for a due pass motion. The remaining items are suspense. Candidates AB 292 Pellerin is still listed on the agenda in the Daily File, but it will be rescheduled for next hearing on July 10. Before we begin, obviously we still don't have a quorum, and so we are going to remind all witnesses to limit their testimony to the fiscal aspects of a Bill and to refrain from prior testimony and relitigating the policy merits.
- Anthony Portantino
Person
We are a fiscal Committee and Finance in the House. Exactly. We go to my other set of notes here. Yes, of course. I even get the moderator involved too. Since Assemblymember Bauer Kahan is here with AB 521, we will take that out of order. It is a do pass recommendation and we will start out with some 80s trivia.
- Rebecca Bauer-Kahan
Legislator
Ooh, 80s.
- Anthony Portantino
Person
What was the name of David Hasselhoff's car in Knight Rider? Was a talking car.
- Rebecca Bauer-Kahan
Legislator
Does finance know? I thought we were going to go Baywatch when you said David Hasselhoff. Yeah, exactly. Thank you, Senator.
- Anthony Portantino
Person
Mark knows. Kit. Kit.
- Rebecca Bauer-Kahan
Legislator
Impressive.
- Anthony Portantino
Person
All right, since you didn't get that one right, we're going to come back to you with a second.

So there is a Netflix television series set in 1980s Indiana and it is called.

My staff watches more television.
- Anthony Portantino
Person
Who knows? You always know everything. All right. Tell us: Stranger Things. All right, next time you will I.

- Anthony Portantino
Person
All right, tell us about AB 521, which is on occupational safety and health standards.
- Rebecca Bauer-Kahan
Legislator
Thank you, Mr. Chair and Members. AB 521 ensures equal protection through restroom access on job sites. AB 521 simply ask Cal OSHA to revisit its standards for restroom requirements on construction sites to ensure separate facilities for women. This will protect women in the trades from the health risks and intimidation they face in restroom access today. The costs of Department are low and will be easily made up by the benefits that women will have on the job sites. I know it is a priority for this Legislature to get more women into the trades and this Bill will help us do so.
- Anthony Portantino
Person
Do we have witnesses?
- Rebecca Bauer-Kahan
Legislator
No.
- Anthony Portantino

- Rebecca Bauer-Kahan
Legislator
This time, I would have paid attention to my text because people are texting me the answers.
- Anthony Portantino
Person
Oh, that's cheating.
- Rebecca Bauer-Kahan
Legislator
I still didn't get it right.
- Anthony Portantino
Person
This one I actually asked at the last meeting, but it's an easy one. So, in her 1983 hit Holiday, since we talked about vacations, what one name singer declared it would be if we took a holiday. Took some time to celebrate just one day out of life. It would be so nice.

Finance is currently opposed to the Bill as we estimate establishing and maintaining these programs would put cost pressures on the General Fund likely in the millions to tens of millions of dollars.
- Anthony Portantino
Person
Do we have any questions on 447? Seeing no questions or comments, without objection, maybe 447 will move to suspense. Mr. Weiner? 1983, Ronald Reagan proposed the Strategic Defense Initiative, which was laser beams. What did the public call it? Star wars. Star wars. All right. Good. See, it was an easy one. You knew that, too, didn't you?
- Angelique Ashby
Legislator
Yes. That was much easier.
- Anthony Portantino
Person
The one than Delaware. Delaware. I told you Delaware was a hard one. All right, moving on to AB 775 Arambula, personal services contracts. It's a suspense candidate. And we have a supporter.
- Alia Griffing
Person
We do. Good morning, Mr. Chair. Members of the Committee. Alia Griffing with the American Federation of State County Municipal Employees. We are a co sponsor of this Bill and urge your support. The analysis identifies $214,000 for implementation of the pilot program. We believe there will be significant cost savings from the use of direct agency staff rather than the very expensive contractors. Thank you.
- Anthony Portantino
Person
All right. Any other support? Seeing no support, how about opposition to AB 775? Seeing no opposition, how about we go to the phone line for support or opposition of 775?
- Unidentified Speaker
Person
Support or opposition? 775, press one, then zero. At this moment. And Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
No support or opposition. Do we have a file?
- Michele Perrault
Person
Yes. Finance is currently opposed. As noted, the cost would be $214,000 into positions starting in 24-25, running until 2029 out of General Fund. In addition, we would note that we believe compensation with regards to this program would be more appropriately handled through the budget and labor negotiations process.
- Anthony Portantino
Person
All right, any questions or comments from my colleagues? Without objection, AB 775 will move to suspense. We have AB 521 on call, but we're still missing one person. So we'll leave it on call and we'll move on to AB 556 Gallagher, property taxation, transfer of base year value, disaster relief. It's an urgency matter and it is a suspense candidate. The author's waived presentation. We'll open up the public hearing. We have no one here to speak in support. How about we go to opposition of 556? We see no opposition. How about we go to the phone line?
- Unidentified Speaker
Person
Support or opposition? For AB 556, please press one, then zero. Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
No support or opposition. Do we have a file on 556?
- Michele Perrault
Person
Finance does not have an official position. However, we would note currently, because we are in test one, there would not be any revenue losses incurred. However, if the state was to move out of test one, the property tax revenue lost by schools would have to be backfilled by Prop 98 General Fund on a dollar for dollar basis.
- Anthony Portantino
Person
We have taken Finance. Do we have any questions? We have no questions or comments from our colleagues. So without objection, AB 556 will go to suspense. Senator Wahab, in the 1980s, there was a pretty cool product that was advertised on television all the time. That was a sound activated way to turn lights on and off. What was that called?
- Aisha Wahab
Legislator
Clap on.
- Anthony Portantino
Person
Clapper. The Clapper. The Clapper. Clap on. Clap off. You were close. The Clapper. Good job. All right, we're doing 80s trivia. Just so. All right. 556 will move to suspense, without objection. Moving on to AB 567 Ting, Criminal Records release. It's a suspense candidate and the author has waived presentation. We'll open up the public hearing with 567 for support. Seeing no support, how about opposition? We have no opposition of 567. Let's go to the phone line for support or opposition.
- Unidentified Speaker
Person
Support of opposition for AB 567, press one, then zero. Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
We have no support or opposition to 567. But do we have a file?
- Michele Perrault
Person
No file.
- Anthony Portantino

We have no file and we have no questions. So without objection, 567 will move to suspense. Since we have a full House, let's lift the call on AB 52 Bauer-Kahan, which is a do pass to the Senate Floor.
- Committee Secretary
Person
AB 521, the motion is do pass to the Senate Floor. Chair voting aye. Senator Jones? Senator Wahab? Wahab, aye. Senator Weiner? Aye. Weiner, aye.
- Anthony Portantino
Person
That Bill is out five to zero. So we will dispense with that and then we will move on to AB 881 Ting, juror fees, pilot program. It's a suspense candidate. The good author's waived presentation will open up the public hearing in this room on 881. Seeing no one come to speak in support, how about opposition to 881? Seeing no opposition. 881. Moderator, please tell us if there's so many people out there who just have nothing better to do this morning than to talk about 881 for support or opposition.
- Unidentified Speaker
Person
For 881, please press one, then zero. At this moment, Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
I guess they all had something better to do. All right, Finance. 881.
- Michele Perrault
Person
No file.
- Anthony Portantino

We'll open up the public hearing in this room on 649, seeing no one coming to the microphone in support. Is there any opposition to 649? We have no opposition to 649. How about we go to the phone line to see who wants to share their views of AB 649?

- Anthony Portantino
Person
No support or opposition to 695. Do we have a file?
- Michele Perrault
Person
Yes. Finance is currently opposed to the Bill. We show a cost estimate of $158,000 in General Fund as well as one position ongoing. And while the Bill does not specify grant amounts, given the high cost of the infrastructure, we estimate it would likely be in millions of dollars in grant funding to allocate to counties, to address the needs.
- Anthony Portantino
Person
All right, do we have any questions on 695? Seeing none, without objection, 695 will move to the suspense file. Moving on to Mr. Gibson AB 767: community paramedicine or triage to alternate destination act. It is a suspense candidate. The author's waived presentation. We'll open up public hearing in this room. For anyone wishing to speak on 767, now is your opportunity. No one has come to the microphone. Do we have any opposition to 767? We have no opposition. Moderator is there anyone on the phone line that wishes to share their views of 767?
- Unidentified Speaker
Person
Once again, for 767, press one, then zero. Support or opposition? Mr. Chair, we have nobody that has queued up.
- Anthony Portantino
Person
We have no support or opposition of 767. Do we have a finance report?
- Michele Perrault
Person
Finance is currently opposed to the Bill. We show costs of 644,000 in 23-24, 564,000 in 24-25 and 414,000 annually ongoing through 30-31 of General Fund. And we would note that these costs would not be absorbable within the existing resources.
- Anthony Portantino
Person
All right, we have any questions or comments from my colleagues? Seeing none, without objection, 767 will move to suspense. AB 997 by Gibson: Exoneration Mental Health Services. No support or opposition. But do we have a file?
- Michele Perrault
Person
No file.
- Anthony Portantino
Person
We have no file and we have no questions. So without objection, AB 997 will move to suspense. This singer tragically died this year and after her successful song Private Dancer starred as a villain in what 1985 movie? Who knows? Mad Max. Thunderdome. Tina Turner. Mad Max beyond thunderdome. Good job. All right, moving on to AB. But she was a lovable villain. She was a lovable villain. Exactly. Yeah, exactly.
- Anthony Portantino
Person
AB 787 by Gabriel: pupil instruction, digital citizenship and media literacy. It is a suspense candidate. The author's waived presentation. And let's see if anybody wants to speak about 787. And no one wants to speak about 787, by the way. People are saying the questions are too easy this time. So I need to get these people. I need to get more difficult questions. Yes, put them on notice. 787. Let's open up the public hearing. There's nobody here to speak in support. How about opposition? No opposition. Moderator tell us about 787.
- Unidentified Speaker

- Unidentified Speaker
Person
And with that, Mr. Chair, we have no further support or opposition.
- Anthony Portantino
Person
No support or opposition of 787. Is there a finance report?
- Michele Perrault
Person
Finance is currently opposed to the Bill. We show a cost of $262,000 General Fund over three years. And we would note that it's unclear the need for the Bill, given the existing arts education curriculum framework already includes some of these elements.
- Anthony Portantino
Person
All right, we've taken our Finance report. Is there any questions? Seeing no questions on 787, without objection, that will move to suspense. AB 798 by Dr. Weber on female genital mutilation. - Nathan Pierce
Person
I'm actually opposed. Should I do that now or what?
- Anthony Portantino
Person
Let's see if there's anyone in support. Seeing no one in support, how about opposition?
- Nathan Pierce
Person
All right. Thank you, Mr. Chair and Members. Nathan Pierce. On behalf of Private Home Educators of California and Child and Family Protection Association. AB 1057 seeks to assign a social worker to visit the home of every child at birth in California. The increased workload of social services in California would no doubt need to lead to the hiring and training of new staff. And this financial burden would lead to an impact on families due to higher taxes. And we're concerned, obviously, with other issues with the Bill policy wise, but as far as fiscally, we're concerned for the families impacted by taxes. Thank you so much.
- Anthony Portantino
Person
All right, before you go, so in the eighties got their own movie. Can you name one of the two Ewok movies? Anybody know any of the he's thinking.

Say it again. The Ewoks. They got their own two movies. You all give up? Caravan of courage and ewok adventure and then ewoks the battle for Endor, just in case anybody was paying attention. Pretty sure it was Empire Strikes Back, the one where they came in, anyway. All right, moving on. Okay, we've taken our support and opposition of 1057. Let's go to the phone line.
- Unidentified Speaker

Person
With that no further support or opposition.
- Anthony Portantino
Person
No further support or opposition to 1057. Do we have a file on 1057?
- Michele Perrault
Person
Finance is currently opposed to the Bill. We do show ongoing costs between $313,000-750,000 General Fund beginning in 24-25. We would also note that if all of the local health departments, they've expressed interest in 16 additional models, if all were approved, that would result in a total ongoing General Fund costs between 5 million and $12 million.
- Anthony Portantino
Person
All right, we have our Finance report. We have no questions or comments from my colleagues. Without objection. 1057, will move to suspense. - Nick Sackett
Person
Hello, chair Members. Nick Sackett for social compassion in legislation. Proud sponsors of the Bill. The latest DOJ crime report showed only 114 arrests for the animal abuse crimes listed in this Bill. And for this Bill to apply, those arrests would have to lead to probation. The few actual convictions, combined with the state only incurring costs when the defendant can't afford the mental health treatment, leads us to believe that there will be very minimal cost to the state.
- Nick Sackett
Person
Just like to mention the Uvalde, Texas and Buffalo, New York. Perpetrators of mass shootings. There were both known animal abusers. So we need to get these folks help. An ounce of prevention is worth a pound of cure in these instances. Thank you.
- Anthony Portantino

Finance is currently opposed to the Bill. We note it would require up to $2.2 million General Fund and three permanent positions in fiscal year 24-25 and ongoing to maintain and update the registry and screen providers. Additionally, it's estimated that there could be unknown, but likely significant General Fund costs to procure the new hardware and software to develop and maintain the registry. And these costs are currently not absorbable within existing resources and would create ongoing General Fund cost pressures.

Mark reminded me that I always ask my standard question on 1066, which we're not doing today, but I'll ask the question anyway. What's significant about 1066? The year I'm sorry? The Battle of Hastings. The Battle of Hastings. 1066. A couple of weeks ago, too. Yeah, I always do 1066. Mark reminded me all right, so 1065, without objection, we'll move to the suspense file.

1121 Haney Public Works ineligible Lists It's a suspense candidate. The author's wave presentation will open up public comment with 1121. There's no one here wanting to speak in favor of 1121 and there's no one here wanting to speak in opposition of 1121. How about anyone at home cleaning the grill, getting ready for their 4 July barbecue that had to be here to speak on 1121?

Mr. Chair, no support or opposition.

No support or opposition. Do we have a file on 1121?
- Committee Secretary
Person
Finance is currently opposed to 1121. We note a cost of $910,000 in 2425 and $399,000 annually ongoing from the state Public Works Enforcement Fund to upgrade the information technology systems. The Finance notes that the Fund is structurally deficient and currently has expenditures expected to exceed revenues by approximately $8 million in 23-24.

All right, any questions about 1121? From my colleagues? Seeing no questions without objection, 1121 will move to suspense. 1127 was a very interesting year for history. Does anybody know what happened in 1127? Of note, anybody know King Tut's tomb was open for the public in 1127? Who knew? All right, that was a long time actually, on 1127, so that's what the significance? It was 1127. So that's why 1127 was of interest. 1127, King Tuts, January 1 in 1927. Wait, yeah, 1927.

We have no file. We have no questions. Without objection, 1127, we'll move to suspense. AB 1203 bans sales and use tax exemptions for breast pumps and related supplies. It is a suspense candidate. The authors waive presentation, it's a tax levy. And we will open up the public comment right here in this room on 1203, seeing no supporters, do we have opposition of 1203, seeing no opposition, let's go to the phone line for support or opposition of 1203.
- Committee Secretary
Person
Support or opposition? For AB 1203, press one, then zero.
- Committee Secretary
Person
Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
No support or opposition to 123. But do we have a file?
- Committee Secretary
Person
Finance is currently opposed to 123. We estimate the Bill will reduce General Fund sales use revenue by 1.7 in 2324, 7.1 million in 24-25 and 7.6 million in 25-26. In addition, the Bill will reduce local government sales and use tax, which by the Constitution requires that the local revenue be backfilled by the state.
- Committee Secretary
Person
Therefore, we would estimate that General Fund will incur additional estimated costs of 460,2324, 1.9 million in 24-25 and 2.1 million in 25-26 to backfill the local revenue Fund.
- Anthony Portantino
Person
All right, thank you. Do we have any questions or comments? Seeing none, without objection. 1203 will move to suspense. Moving on AB 1213. Ortega workers compensation, aggregate disability payments. No support or opposition. Do we have a file?
- Committee Secretary
Person
Finance is currently opposed to 1313. We note an estimated 3.5 million to 5.5 million General Fund annually through the completion of the pilot program, which is through 2030 for local assistance grants. We would also note that it would continue to create ongoing General Fund cost pressures to the extent an appropriation is included in the annual budget.
- Anthony Portantino
Person
Thank you. Seeing no questions or comments from my colleagues, without objection, 1313, we'll move to the Suspense file AB 1215 by Wendy Carrillo on Pets Assistance with Support grant program and homeless shelters, domestic violence shelters. Unfortunately, we have no further support or opposition.
- Anthony Portantino
Person
How about that, Herman? Come here. Anyway, that's a Munster's reference if anybody cared. All right. Finance.
- Committee Secretary
Person
Finance is currently opposed to 1215, and we believe it creates unknown General Fund cost pressures by establishing a new statutory program without an appropriation. However, we do estimate annual General Fund cost pressures could be in the low millions of dollars.
- Anthony Portantino
Person
All right, seeing no questions from my colleagues, without objection, 1215 will move to suspense. AB 1254 by Assembly Member. Flora on state employees compensation. It is a suspense candidate. The author's wave presentation and let's see if anybody wants to talk about 1254. Seeing no one in support, how about opposition? There's no opposition. AB 1254, press 1 and 0. At this moment, Mr. Chair, we have no support or opposition.
- Anthony Portantino
Person
No support or opposition at 1254, but do we have a file?
- Committee Secretary
Person
Finance is currently opposed. AB 1254. We estimate the Bill will cost $537.1 million, of which 330.4 million is General Fund in 23-24 to implement the increased salaries for BU eight rank and file Members employed by CalFire. We believe the costs could increase in future years, up to 99.6 million, of which 61.3 million is General Fund per year. Based on changes.
- Committee Secretary
Person
As we survey fire Department salaries, we would note that this would create significant ongoing costs and would eliminate the state's ability to negotiate salary increases for BU eight Members employed by CAL FIRE through the collective bargaining process.
- Anthony Portantino
Person
All right, we've taken our support in our opposition. We've heard from finance. Do we have any questions on 1254? Seeing no questions on 1254, that Bill will move to suspense without objection. - Committee Secretary
Person
Sure.
- Anthony Portantino
Person
Which women's musical group had number one hits in the 1980s with Walk Like an Egyptian and Eternal Flame?
- Committee Secretary
Person
That would be the Bengals. And did you know that the Bengals were the second group to have an all female group to have a number one song?
- Anthony Portantino
Person
Who was the first?
- Committee Secretary
Person
The first were the Gogos.

The Gogos. But didn't Diana Ross and the Supremes had number ones, so I think they were probably the third. But thank you. All right, moving on. So, 1439. We've taken our support and our opposition, right? How about we come to Finance?
- Committee Secretary
Person
Finance has a neutral position on the Bill, and according to the California Tax Credit Allocation Committee, the Bill would have no fiscal impact on the state.
- Anthony Portantino
Person
No fiscal impact. And no questions. Without objection, 1439, we'll move to suspense. AB 1473. Manchine school curriculum, health framework, physical education framework, compression only, cardiopulmonary resuscitation, automated external defibrillators. That's a lot. And we have no one wishing to come to the microphone to speak in support of 1473.
- Anthony Portantino
Person
And we will go to opposition, and there's nobody who wants to say all those words again, so we have no opposition. Moderator how about we go to the phone line on 1473.

Person
All right, we've taken our comments from Finance. We have no questions from my colleagues. So without objection, AB 1508 will move to the suspense file. That concludes our business for today.
