Good morning, Mr. Chair. Craig Pulsar on behalf of Equality California, proud co sponsor of ACA 5. As you know well, marriage quality is currently the law of the land set thanks to several previous decisions by the U.S. Supreme Court. However, it's becoming increasingly clear that the current Supreme Court cannot be trusted to uphold their precedent or protect our civil rights. Last year, the Court overturned 50 years of precedent affirming the constitutional right to an abortion.

And just last month, the Court decided to once again ignore years of precedent and allow certain businesses to discriminate against LGBTQ people. ACA 5 is an important and necessary safeguard in case the Court were to once again ignore years of precedent and roll back protections for same-sex or interracial couples to marry. The measure will put a constitutional amendment before voters to repeal Proposition Eight, erasing a dark part of California history, and protect once and for all the fundamental freedom to marry.

Administrative costs associated with putting ACA 5 on the ballot are worthwhile to ensure Californians continue to enjoy the freedom to marry. And they represent a much smaller price tag than the potential cost of trying to defend marriage equality should the Supreme Court overturn any of its previous decisions. ACA 5, of course, will not end discrimination against LGBTQ people, nor will it end the hateful attacks we are seeing against the community across the country.

Just to underscore a few points, we have about 3600 Members working in the Department of State hospitals. Last year alone, there was 2700 assaults on staff. However, this Bill originated out of the Department of Corrections, where one of our nurses was doing rounds and discovered a brutal slaying in one of the cells. The inmate had decapitated and dissected his cellmate.

The nurse had to report once she discovered this to a correctional officer. The correctional officer had a PTSD presumption. Our nurse did not. It took her 18 months to get treatment and get her workers compensation claim approved. His was approved immediately because he had the presumption.
