Thank you. Mr. Speaker and Members, I rise to present HR 108, which recognizes July 4, 2024 as the 248th anniversary of the birth of the United States and the signing of the declaration of Independence.

As Chair of the Military and Veteran Affairs Committee, I want to note that this resolution also encourages Californians to honor and express gratitude for those who have served in the armed forces, especially those who have suffered injury like my dad has, and made the ultimate sacrifice in pursuing the foundations upon which our country was founded on democracy.

It is fitting that the Legislature recognizes and celebrates July 4 in order to promote greater knowledge of the history of the significant day and to demonstrate appreciation for those individuals who have continued to defend and pursue and promote its ideals.

Since its adoption and bold pronouncement more than two centuries ago the Declaration of Independence and the principles which animate that timeless document have inspired literally billions of persons around the world to pursue freedom in their own nation, for themselves and their loved ones, and for their communities.

And remain today a perfectly unrealized goal to which all Americans and all who cherish liberty must rededicate themselves.

On this and every 4 July, it is important that the institutions of the California government, and indeed all Californians, express heartfelt gratitude and indebtedness to those men and women who have served in the armed forces of the United States and in particularly those who have suffered injuries in battle and who have made the ultimate sacrifice protecting freedom and liberty around the world.

Recalling the words of President Abraham Lincoln that this is a result of their profound sacrifice, and this nation, under God, shall have a new birth of freedom, and that the government of the people, by the people, and for the people, shall not perish from the Earth.

Mr. Speaker, Members, I rise today to present amendments to SB 1381. As announced today, Governor Newsom and legislative leaders are introducing this ballot measure to reflect targeted reforms to Proposition 47 that focused on repeat offenders, serial shoplifters, and fentanyl dealers, while increasing resources for drug treatment programs.

Mister Speaker, I rise in strong opposition to these amendments for two reasons. One, this entire process has been a sham. But most importantly, there is a fake Alexandra's law that purports to hold fentanyl dealers accountable. Well, I got news for you. Should surprise nobody, it doesn't.

As I hope you know by now, Alexandra died of fentanyl poisoning shortly before Christmas in 2019. But here is what's absolutely shameful about these amendments. Did anyone bother to call Alexandra's father? Because I did. And the answer is no.

No one here, not the Governor, not the author, no one from the majority party had the courage to call Matt and ask him if you could use her name in this language. As a human being, how would you like that? How would you like your loved one being used without your permission?

I just have to say, this is shameful. Out of respect to the family, please reject this absolutely shameful attempt to use her name to Prop up the Governor's also shameful attempt to deceive voters and confuse them on the actual Alexander's law. With that, I ask for a no vote.

Thank you, Mr. Speaker. I also rise in opposition to these amendments and I'm just. I hope you're not going to do this, man. I really do. All year long we've had this discussion about what to do to really combat retail theft. We have a bipartisan package, which is a good package. We'll be voting on that later.

But we've had all these different schemes throughout the whole time. The poison pill amendments, I'm glad those are getting taken out of.

But now here today, we're amending this bill at the last moment, all to put a competing initiative on the ballot with less than 72 hours notice that we're going to go vote on this. When it hasn't been well thought out, when it actually, when actually the author and many others have been saying we don't need to reform Prop 47.

All year long that's been their position. We don't need to reform Prop 47. But now here they are in the last minute making a reform to Prop 47 to put on the ballot. Why? There's only one reason.

It's to confuse and distort the November election and to put this alternative ballot on there when there's already one that's qualified, that many support, that has bipartisan support. That initiative already has bipartisan support and actually does something on retail theft. And by the way, these amendments don't be fooled. They don't stop retail theft.

They do very little to stop retail theft. In fact, with the $50 threshold, someone could steal 19 times before there's actually a felony that would be brought against them. And on the fentanyl front with these amendments and what's being put on here, my good colleague just brought up what's going on with Alexandra's law. A distortion.

Didn't even talk to Matt about how this should be put in. But even more so, it's going to let most of the fentanyl dealers actually off the hook and say it's only in the case that someone knowingly cut it into a pill. That's a high burden to meet.

And also the victim has to not have known or was unaware of what they were given. Well, guys, most of the time the victim's dead when they take that pill. So they're not going to be testifying. It's not a real reform, it's fake reform. But we have an opportunity to say no to it.

We're going to be debating the main merits of this measure later this week, I guess after 07:00 on Wednesday on the eve of 4 July, which maybe that's another point, man. Like here we are celebrating 4 July and the democratic process.

And I just gotta ask you guys, does this look like the democratic process that we should have last minute amendments to put an initiative on the ballot? Is that a real democratic process that went through committees, that had vetting, that had public input?

Is that the kind of democratic process that's respectful to our founders? Who did say they wanted a place of liberty where there was real input, where there was real representation? So I'm sorry that I always have to be the one to do this, but somebody has to say it. Stop letting the Governor do this to us.

Stop letting them push through things, through this Legislature. Stand up for yourselves, stand up for this institution and say, no, this is not the right way to do it. And we could do it right now by voting down these amendments. I hope you will.

I hope we won't let this go forward because it's not fitting with July 4 and the foundations of our democracy. Thank you.

Thank you Mister Speaker, Members. I rise today to present Senate Bill 674 on behalf of Senator Gonzalez, which will create statewide standards for the existing refinery fence line and community air monitoring program.

It's been seven years since the program launched and unfortunately there have been serious deficiencies in implementation that are depriving fence line communities of the information and alerts they need to protect their health and well being.

Specifically, real time alerts are not being sent, fence line data is not available online, dangerous pollutants are not being monitored, and some refineries have even exempt have been exempted from the program altogether.

SB 674 makes necessary changes to the program to ensure better compliance with the core pillars of the fence line monitoring law, including public health data collection, monitoring and accountability. For too long, communities across the state have been overburdened by refinery air pollution.

SB 674 will ensure that there is greater transparency about the pollution entering our communities and require corrective action when dangerous levels of air pollution are detective the author has taken numerous amendments, worked in good faith, and engaged extensively with all stakeholders. The bill is in front of you, is fair, balanced and will protect community health.

Thank you, Mr. Speaker and Members, I rise today to honor the life of Dominga Bustamante, a lifelong pillar of her community and a caring mother, grandmother and great grandmother who passed away in May at the age of 89.

I want to highlight that Dominga is the mother of a dear friend, a mentor, a trailblazer for many of us Latinos former lieutenant Governor and Assembly speaker Cruz Bustamante. At an early age, Dominga's family migrated to California for agriculture work, settling in the City of Dinuba in Tulare County.

There she met her high school sweetheart, Cruz Bustamante Junior, who would become the love of her life. Together, they would have six children, Cruz, Belinda, Dorothy, Ron, Andrew and Naomi. The pair moved to San Joaquin in Fresno county and there Dominga became a local social and cultural icon.

Seeing the needs of her community and driven by the deep faith in Catholic social teachings, she stepped up anywhere and everywhere she saw she could help. Domingue help families obtain Social Security benefits as a Yde Vista volunteer, served as a community organizer for the Fresno Community service organization and worked with the Fresno County Office of Education to develop summer jobs and programs for local youth.

She continued her life of service into retirement, volunteering at the Fresno Food Bank, teaching the catechism, and welcoming new Hindu and Sikh families moving to the area. For her decades of work, she was honored with a lifetime achievement award by the California Latina Leaders in Action and with the bishop's catholicist appreciation certificate by the Diocese of Fresno.

Her dedication to her faith and her devotion to uplifting the people around her have shaped Fresno County to be the place it is today. Dominga will greatly be missed and is survived by her six children, 13 grandchildren, 24 great grandchildren, and her sisters in laws, Vida and Vera, who join us today in the gallery.

Thank you, Mr. Speaker and Members. Today I rise to honor the life and legacy of Anna Percy, a former mayor and a trustee for Anaheim Union High School District. She was a community leader whose unwavering commitment to children's education has left an indelible mark on our community.

I had the pleasure of witnessing firsthand her passion for education and tireless advocacy for our students. I often saw Anna at awards ceremonies, ribbon cuttings. She loved to honor the students of Anaheim. She loved going to their musical performances. She really enjoyed her job as a trustee.

Last I saw Anna was at the Magnolia High School Garden where we were not only so excited for the students and what they were accomplishing as gardeners, but also she shared her passion for gardening and I too enjoy gardening. Anna Percy was born on June 171943 in Louisiana.

She began her teaching career in 1968, shaping young minds as a 7th grade geography teacher, art teacher and literature teacher at Trident Junior High School. Ms. Percy was even a teacher for my legislative aide, Christopher Aguilera. Throughout her 37 year tenure in the Anaheim Union School District, Anna's passion for education and devotion to her students never wavered.

In 2006, just a year after retiring from teaching, Anna embarked on a new chapter of service by running for and winning a seat on the Anaheim Union High School District School Board, a role she fulfilled with dedication and integrity.

Beyond her educational contributions, Anna served the community of Cyprus as a Council Member and a mayor, demonstrating her commitment to public service and civic engagement.

One of the things that I really appreciated about Anna Percy is that in a time when we are so polarized and we often see people standing at the edges, she was a Republican in Orange County, I was a Democrat, and yet every time I saw her, none of that mattered.

She was always warm, friendly, engaging, and she put the partisan business aside. Though she may no longer be with us in person, her spirit lives on in the hearts of all who knew and loved her. May her legacy remind us of the profound difference one person can make in the lives of many.

To Anna's family, friends and all who mourn her loss, may you find solace in the memories you shared and the profound impact she had on us all. Anna is survived by her loving family, including daughters Kenna Durazo and Rachel Cameron Kerr and her six cherished grandchildren. Please join me in honoring the life and legacy of Anna Percy. Thank you.

Thank you, Mr. Speaker. Members, today I rise to ask this body to adjourn in the memory of Robert Bob Sidney Kelley of Indian Wells, the longtime publisher of Kelley Blue Book.

Born in Los Angeles in 1927, Bob Kelley graduated from Los Angeles High School in 1945 and then attended the University of New Mexico's naval aviator training program during World War Two. At the end of the war, he left the Navy and Bob joined his family's car dealership, which was launched in 1918 with just three Model T Fords.

According to the LA Times, at one point the Kelley Car Co. was the largest Ford dealership in the world. The dealership sat in the heart of Los Angeles on Figueroa Street and became central to Southern California's car culture. Bob's father, Buster, started the Kelley Blue book in 1926.

Bob Kelly would help the family dealership sell hundreds of used cars per month. He became known for his expertise in appraising automotive vehicles, reconditioning and pricing, and eventually took over management of the Kelley Blue Book. Bob extended Kelley Blue Book's coverage to imports, trucks, motorcycles, RVs, mobile homes, and new and classic collector cars.

The Kelley Blue Book became not only a go to resource for the automotive industry, but also a vital resource for banks, dealerships and courts. Bob oversaw the Kelley Blue book's expansion to the Internet. To this day, the Kelley Blue Book is recognized by the US Government as an official guide.

Bob is survived by his wife of more than 50 years, Wanda, his sister, five children, 12 grandchildren and 10 great grandchildren. I ask that we adjourn the Assembly today in memory of Bob Kelley.
