The Senate Committee on Appropriations will now come to order. We are meeting Today in room 2200 of the O Street Building. We would like the missing Members of the Committee to come on down to the room so that we can start with a quorum, and it looks like we probably have one right this minute.

We have 93 measures on today's agenda, all of which are suspense file candidates. There are three bills still listed in the daily file that will not be heard today. So if you're here for these three bills, we're going to be hearing them next week. They are SB322 by Senator Menjavar, SB593 by Senator Hurtado.

They've been rescheduled for next week. And SB 547 by Senator Perez will be sent directly to the Senate Floor pursuant to Senate Rules 28.8. So that Bill is directly to the floor. The Department of Finance has let us have.

Madam Chair Chris Micheli on behalf of the Civil Justice Association of California. Normally don't get up with the author not present, but I did want to note, although we opposed on policy grounds, I appreciate the fact that your Committee regularly pulls in measures dealing with civil code changes to consider the fiscal implications.

We believe on policy grounds that this is likely a preempted by the Federal Arbitration Act. You may recall half a dozen years ago when there was an Assembly Bill that went through similar FAA litigation. The Eastern District at the district court level in the 9th Circuit both struck that law down.

The state was ultimately on the hook for $800,000 in fees. So we think that this Bill is also subject to FAA preemption and would just note the potential fiscal consequences of that. Thank you, Madam Chair.

Yeah, Madam Chair, thanks so much. I don't like to interrupt the flow, but this will be my once a week pointing out of when we, when we get fiscal estimates from agencies that are not directly overseen by the state.

And I know the Committee staff does an excellent job in this, but I just, I'm planning on calling out these once in a while. And so we have it for this Bill which just creates a financial aid template letter that's common.

University of California is estimating three quarters of a million while the California State University estimates minor absorbable costs, as does everyone else.

And when we get these estimates that don't come from agencies that are overseen by our Budget Subcommittees in their line items, I know it can be attempting to use fiscal estimates as ways to oppose bills, but this Committee takes very seriously getting those right.

And so I just want to point that out, maybe do this occasionally for agencies who are seem to be more strategic in their fiscal analysis than they then they might be accurate. But it's, it's $300,000 in this estimate so that a couple of financial aid officers can go to a Committee meeting three times in a year.

And obviously we depend very much in this Committee and rely on agencies to provide us with meaningful estimates. So Just to point that out, it is still a suspense candidate. So support the motion. But I just want to urge agencies to provide us with accurate estimates so that we can do our job effectively.

Comment very well taken. And that also applies to departments in the state organization, because there are sometimes that a report that looks very similar to something that someone else has written will cost a lot of money if they don't want to do it, and not too much money when they're interested in doing it.

How about in opposition Will Abrams from the Utility Wildfire Survivor Coalition in strong opposition to this Bill. The fiscal analysis doesn't take into account the fact that that the California Wildfire Fund is not sufficient to pay victims fully for their losses. There talks about a historic energy justice assessment. It goes into different communities about the fiscal impacts.

It however, does not touch at all and does not account for justice for victims and the full restitution for victims. There's a feasibility assessment rubric that talks about the impacts to local and economic benefits, but does not look at how we are not paying victims for the fires and that needs to be included.

The cost recovery aspect of the Bill describes an electrical corporation has to pass the cost of wildfire, can't pass the cost of wildfires on to ratepayers.

There is nothing within this Bill that talks about the impacts to of fire victims who have not been paid from the PG&E fires who will not be paid from the LA fires if the Bill does not incorporate those things.

By bypassing the fiscal impacts to victims, it neglects those impacts and undermines the recovery and resiliency of our victims and our communities. I understand that this Bill is absolutely well intentioned, has a lot of positive action aspects, but unless it accounts for the victims of fires, it cannot be effective. Thank you.

Chair Caballero and Committee Members Glenn Allen, representing the California Welfare Fraud Investigators Association, known as CWFIA. We respectively oppose SB560. CWFIA is composed of peace officers like myself, county and state social services eligibility workers, supervisors and managers in the welfare departments.

My testimony today is presented to protect money for our most vulnerable parents, children and the taxpayers. The California Department of Social Services has reported a preliminary and in my opinion, it's a superficial estimate that this Bill will cost $21 million to several million more.

Our agency, CWFIA, has contacted most county welfare fraud units in the state and believes the CDSS estimates are low and could rise many millions of dollars. After a complete analysis, SB560 proposes using administrative disqualification hearings to process fraudulently obtained overpayments in CalWORKS and the CalFresh programs.

At the present time, only nine counties are using this process that the Bill is trying to push through. The CalWORKS budget is currently underfunded by $300 million per experts familiar with the budgeting process.

This Bill would divert millions of dollars away from our most vulnerable parents and children to it would waste taxpayers money to change a system that is functioning properly. Thank you.
