Good morning, everyone. Welcome to the April 302025 Assembly Appropriations Committee hearing. We have 113 bills to consider this morning as part of our regular order hearing. Before we begin, I have a few housekeeping notes to cover. First, I would like to thank Assembly Member Alanis for filling in first Member Tangapa on the Committee today.

Also, AB375 from Nguyen is pulled from today's hearing. We encourage the public to provide written testimony before the hearing by visiting the Committee website at apro Assembly Ca.gov Please note that any written testimony submitted to the Committee is considered public comment and may be read into the record or reprinted. The hearing room is open for attendance.

All are encouraged to watch the hearing from its live stream on the Assembly's website. We will accept public comment comment on any Bill placed on the suspense file by the Committee today and for which the author waived presentation before the close of the regular order hearing.

Good morning Madam Chair and Members. Today I Today I am presenting AB 1061. AB 1061 removes barriers to housing development by allowing the California Home Act SB 9 of 2021 to apply to historic districts as long as projects do not demolish existing historic structures.

This change prevents the misuse of historic preservation laws to block new housing and expands opportunities for home ownership and multi unit housing in more neighborhoods. One of the things that we have seen since the implementation of SB9, which was lauded as the end of single family home neighborhoods, is exactly the opposite.

There have been very few permits pulled for SB9 and we've also seen that because of the significant loophole in SB9 because it does not apply to historic neighborhoods, there has not been a rush on building these types of projects. With this, I have our friends here from YIMBY who will make comments.

Good morning Chair and Members of the Committee. My name is Max Dubler. I'm a Policy manager at California YIMBY. AB 1061 sets out standards for SB9 duplexes and lot splits in historic districts.

It balances housing production and historic preservation by forbidding SB9 projects at individually listed historic sites and requiring that these projects maintain the street facing appearance of homes that contribute to historic districts. This Bill will have minimal fiscal impacts because local governments have the authority to charge planning fees to cover the related expenses. We respectfully ask for your aye vote. Thank thank you.

Next Members, I am happy to present AB 750 which strengthens shelters accountability, transparency and enforcement of health and safety standards across Californians. California's estimated 13,000 homeless shelters. Prior to this Bill that I am presenting, I had already presented and move forward AB362, which was my first Bill on shelter accountability.

Sadly, even though I'm happy to present this Bill, the compliance with AB362 has been dismal. A CalMatters investigation found that only five of California's 58 children, counties and just four of the state's 478 cities have submitted reports as required by law. I'm happy to report Orange County has submitted a report. But why are these reports important?

Why was the initial Bill important? It simply says that shelters should have basic standards, whether it's for cleanliness, rodents infestation, standards for safety. And these reports were supposed to be submitted. This simply has not happened. And so this Bill is now a companion Bill.

AB750 would strengthen the state oversight and enforcement by empowering shelter residents, requiring shelters to post signage about residents rights and reporting procedures and to provide this information at intake. Also to standardize reporting, establishing a clear reporting requirements and deadlines as well as mandating reports even when no complaints are filed.

And also strengthening accountability, implementing penalties for non compliance, including withholding state funding from jurisdictions that fail to report. This definitely is the hammer. And I know we don't like using the hammer. And I know that there are many jurisdictions that say why do we need to do this?

And it's simply to say we need to follow the law when laws are put into place. Whether we like laws or not, we need to follow them. And why? To have basic standards where as some of us know, we have now individuals living in shelters. Not three months, not six months, sometimes 12 or three years.

Sadly, this is where we are in California. It's not what we want. But if we are going to have state funding for these shelters, we certainly have to have some type of compliance.

The purpose of AB12 is to help ensure public agencies, both local and state, comply with state housing law. It would do so by increasing penalties against these agencies that violate the rights established by the state's housing laws. Again, this is really an enforcement Bill. We vote on a lot of laws. We create a lot of laws now.

They. They must be enforced. As you know, in recent years we have passed numerous statutes to make housing permitting easier and more predictable in an effort to address our ongoing housing crisis. That effort continues this year with the Fast Track housing package, which includes this Bill.

But for these laws to be effective, they have to be easy to enforce and have real consequences when they are broken. Unfortunately, most state housing laws, with the notable exception of the Housing Accountability act, are difficult to enforce.

AB 712 would address this problem by increasing penalties against public agencies that break state housing law by applying the same requirement that exists in the Housing Accountability act to other state housing law.

This Bill would also end the practice of public agencies asking housing development applicants to indemnify the local governments against lawsuits when that agency violates the applicant's rights. This Bill has minor state costs associated with the Department of Housing and Community Development. Responsive. This.

This Bill has minor state costs associated with HCD's responsibility to provide technical assistance to developers and to inform local governments of compliance concerns. Would respectfully ask for an aye vote. Oh, and I have a witness here in case there's any technical questions.
