Existing law defines and regulates the terms and conditions of employment. Existing law generally defines workweek for these purposes and requires that work in excess of 40 hours in a workweek be compensated at a rate of at least 11/2 times the employees regular rate of pay, subject to certain exceptions. Existing law makes a violation of these provisions a misdemeanor.

This bill would expressly require that overtime provisions apply to an employee of the Legislature. By expanding the application of a crime, this bill would create a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.
