Assembly Standing Committee on Rules

June 15, 2023
  • James Ramos

    Legislator

Rules Committee is called order. Please establish quorum.

  • Committee Secretary

    Person

    [Roll Call]

  • James Ramos

    Legislator

Thank you. Thank you for that. We have a consent agenda item. Is there a motion on the consent agenda,

  • Heath Flora

    Legislator

I make a motion that we pull SB 567 from the consent and table it for a week to allow us to have some continued discussion on the referral.

  • Marie Waldron

    Person

Can I just amend the motion? Because when you use table, that's basically no date certain. Just say, defer or rerefer it to next week.

  • Heath Flora

    Legislator

    I'm okay with that.

  • James Ramos

    Legislator

Thank you for the motion. The motion is to table, but let's move forward on the consent agenda that we have in front of us. Is there a motion on the remainder motion? The second? Please call the roll.

  • Committee Secretary

    Person

    [Roll Call]

  • James Ramos

    Legislator

Thank you. Is there a motion on the rest of the consent agenda to refer five, six, seven as presented?

  • Heath Flora

    Legislator

    Clarification as presented?

  • James Ramos

    Legislator

As present. We're going to take a motion on as presented as the double referral, and then we'll take a motion on your motion. Is there a motion on the referring five, six, seven, double referral, housing and judiciary.

  • Evan Low

    Person

Thank you. Mr. Chair, may I ask, just for a clarification, if there might be an opportunity, procedurally to also table this for further discussion at a future hearing?

  • James Ramos

    Legislator

    Okay.

  • Evan Low

    Person

Perhaps in the context of a motion, perhaps to table it to the following hearing.

  • James Ramos

    Legislator

There's been a motion to table it. Is there a second motion? Dixon? Second. So the term table is what's to continue. So what is your motion to postpone.

  • Evan Low

    Person

The decision on referral to our next Committee hearing next week? Give everybody more time.

  • James Ramos

    Legislator

    Assembly Member Ortega,

  • Liz Ortega

    Legislator

Point of clarification, I bet that's what we voted on the first time.

  • James Ramos

    Legislator

This item was pulled from Member Flora. To table it or not, to use the word table it, to continue the item to next week, to have more clarification on it. Clarification now has come. We asked for a motion on the remainder of the consent, which was this item, and now we're having more dialogue on that, which then Assembly Member Lowe is asking the same as Assemblymember Flora to continue the item for further discussion. This item has been referred potentially to housing and judiciary.

  • James Ramos

    Legislator

This deals with housing. This deals with judiciary liability. However, if it's the will of this body to continue to dialogue, that's the will of this body. Assembly Member Pellerin.

  • Gail Pellerin

    Legislator

I was thinking that it was correct to double refer it, but I also will grant the extra week for folks to talk and hash out any differences. So thank you. Mr. Flora's motion, which motion is on the table for a vote right now? .

  • James Ramos

    Legislator

The motion was to approve. There wasn't a motion for five, six, seven as referred to housing.

  • Gail Pellerin

    Legislator

That's the motion on the table right now.

  • James Ramos

    Legislator

That's the motion, but there was no second. So now we're into dialogue. There's been a motion here and a motion here and now we're having discussion on it and then we're going to move forward.

  • Diane Papan

    Legislator

There was no official motion when you asked for a motion. There was no.

  • James Ramos

    Legislator

That's what I said. Assembly Member Blanc, there was no second. There was no motion and no second. Now we're having dialogue on the issue that was brought up, but there is.

  • Gail Pellerin

    Legislator

A motion to continue it at the next Rules Committee next.

  • James Ramos

    Legislator

So we're having discussion and then we'll.

  • Evan Low

    Person

Move into it again. The intention of the motion is to allow for the Chair to help facilitate dialogue for additional items to be addressed. As I know that this for many was last minute issue and to help empower you to help negotiate with existing parties as well, too.

  • James Ramos

    Legislator

We appreciate that the Bill as referred housing, there is housing components in it, deals with tenant evictions, deals with those that would be evicted out of homes, also deals with liability and judiciary. So at this point we still are moving in that direction. As far as a referral to housing and judiciary, we will take this week to look at that and hear from Members, if they so want to call our office and discuss this even further. There's been a motion to continue this item.

  • James Ramos

    Legislator

I'm not sure if we need a motion or we just say we're continuing the item. Yeah, we're removing item five, six, seven from the consent calendar today. If we're removing it, Assembly Member Rubio, then the Bill is not going to be heard today. It'll be moved to a next meeting. If we pull it, then as chair, I'm pulling this item off of consent. So the issue is done. We have till next week to deal with it.

  • Diane Dixon

    Legislator

Procedurally, you still have to deal with a motion that's on the table.

  • James Ramos

    Legislator

I hear you. As chair, we're pulling the consent item off of consent. So the item is not even in front of us today. We don't need it. Are you good with that?

  • Heath Flora

    Legislator

All right, Mr. Chair, through the chair, if we're going to pull SB 567 off of the consent calendar today to deal with it a further, I will withdraw my motion if that is the commitment that we are pulling the Bill.

  • James Ramos

    Legislator

Yeah. Thank you. All right, so Bill SB 567 has been pulled from consent and we will move it to a future meeting.

  • Heath Flora

    Legislator

    All right.

  • James Ramos

    Legislator

So we voted on the rest of the consent calendar. That is up for discussion and we will move forward with that ends Rules Committee. And with that, you referred all of Assembly bills and almost all of the Senate bills except for this one. Now, that's out there, some resolutions coming. So good job.
