Pursuant to 288 the following bills have been rescheduled to our hearing next week. SB 618. Rubio. SB 672. Mcguire. SB 723. Durazo.
Person
Obviously, we do not have a quorum, so we're going to begin as a Subcommitee, and obviously, I want to remind all witnesses to limit their testimony to the fiscal aspects of the Bill and not relitigate the policy. We've had policy Committee hearings on these bills. I'll also, as we go through, decide if we're going to put time limits on testimony, seeing how many people we'll have in the queue, and I'll make that announcement at the appropriate time.
Person
Lastly, the Department of Finance has notified the Committee that they do not have any files on the Bill today. So we will not have a Department of Finance representative on the line with us. And so I think it was the trivia question scared them away. And so we are going to go right to our file as a subcommittee. Mr. Seyarto, you're always on time, so I want to compliment you for being here. Thank you.
Person
And I always have to leave, like, right in the middle, so I could go to. That's okay. Absolutely. New York City. How about that? Let's go to the phone line. For support or opposition to 322.
Person
To speak in support or opposition, press one, then zero at this time. No lines queued up, Mr. Chair.
Person
Imagine that. All right, we've taken support and opposition of 322. Let's move on to 362, which is on data brokers privacy. We'll open up the public hearing. Anyone wanting to enlighten us on SB 362, come to the microphone in support. Seeing no support. How about opposition? Let's go to the phone line, since we have no support or opposition in this room, moderators or anyone on the phone who wants to talk about this Bill.
Person
The speaking of support or opposition, press one, then zero at this time. We have no lines in queue. Mr. Chair.
Person
All right, we have no lines in queue on SB three. Six, two. And we have no quorum, so we will dispense with that when we have a quorum. I see Senator Newman is in the House with our one do pass recommendation, which we will take out of order since he is here. But maybe we'll have to make him answer a trivia question before, as price of taking him out of order, I.
Person
No. Okay, so here's a question for you. So what was the first paper money printed by the Continental Congress called? It's not called the dollar. What was it called?
Person
Continental currency was called the Continental. The Continental. That's my answer. The Continental. I'm sticking with that. I'm saying the continental.
Person
All right. And the bonus question was no. Anyway, all right. Okay, Mr. Newman, you have a Bill which is SB 568 on electronic waste. That is a do pass recommendation. If you can enlighten us about SB 568.
Person
I will try. Good morning, Mr. Chair and Members. Thank you for the opportunity to present SB 568, which would require that an individual entity must certify that they've attempted to locate a licensed instate e waste recycling facility in California before exporting e waste abroad. Globally, less than 20% of e waste is currently recycled properly, with the remaining 80% of e waste ending up either in landfills or improperly recycled in other jurisdictions.
Person
Much of this waste ultimately ends up in developing countries, being processed by hand, and exposing workers in those places to hazardous or carcinogenic substances such as mercury, lead and cadmium. In addition to these adverse health and climate impacts, the improper management of e waste also results in a significant loss of scarce and valuable raw materials such as gold, platinum, cobalt and other rare earth elements that are contained on circuit boards.
Person
Experts estimate that as much as 7% of the world's gold may actually currently be contained in e waste, with up to 100 times more gold to be found in a ton of E waste than in a ton of mined gold ore. That could be your next trivia question. California's e waste recycling market, which is already among the largest in the world, is projected to grow by 15% or more by 2027 if we can streamline the processing and recycling of e waste materials.
Person
The state has a unique and very promising opportunity to become a global leader in the market for safely reclaiming the rare and valuable minerals contained in e waste by requiring recycling facility. By requiring an entity to declare that they attempted to locate an in state e waste recycling facility prior to export, SB 568 will yield immense long term economic benefits for the state while reducing the likelihood that potentially toxic e waste materials will find their way abroad to locations with much weaker environmental standards than California.
Person
We are continuing to work with DTSC, Cal Recycle, and other stakeholders to make the goal and intent of this legislation practicable for all interested and effective parties involved. I am respectfully asking for your I vote today.
Person
Good morning, chair and Members, Rachel Mueller, on behalf of the Wideman Group here with Camston Routers today in support of SB 568. Thank you so much.
Person
Well testified. Anyone else in support? Seeing no one else. Any opposition to SB 568? Seeing no opposition moderator anyone on the phone line in support or opposition to 568.
Person
To speak in support or opposition, perhaps one, then zero. At this time, we have no lines queuing up.
Person
All right, we've taken support and opposition. We do have a quorum right now. So let's call the role and establish a quorum.
Person
Senator Portantino, here. Jones, here. Ashby, here. Bradford, here. Seyarto. Wahab. Wiener. We have four Members present.
Person
Right. And we have seven. Right. So we have a quorum. We do have a quorum. So, Mr. Newman, would you like to close?
Legislator
Sorry, I thought we were. Two questions, sir. Number one, why do we care if this stuff goes to other states? And two, how do you propose that this be enforced?
Person
We care for two reasons, as I mentioned my testimony. One is the environmental impacts of improperly recycling e waste. The other kind of more interesting aspect is this is a very rich opportunity. As I mentioned, there's often a significant amount more valuable metals in a ton of e waste circuit boards than you'll find where you're conventionally mining it. Right. So this is an awesome opportunity to re harvest those. So, you know, this is both environmentally sound but also economically advantageous.
Person
There's a facility in southern Calvary, actually close to your district, near La Jolla, that is actually currently doing e waste reclamation with very little water at extremely safe environmental standards. And they represent the leading edge on this.
Person
That's probably true, and I'm glad to connect. I'm not familiar with your district lines, as you may not be with mine.
Legislator
Back mean, I agree with the properly recycling it or getting the minerals and the heavy metals and stuff out, but why do we care if it's done in Nevada or Arizona if they're doing it as environmentally sound as we are?
Legislator
Okay, my biggest challenge is how are you going to enforce this? Are we going to set up border checkpoints? And as people leave the state, they're going to have to claim their no and they leave or what?
Person
Again, you're providing incentives that hopefully sort of direct waste in the right direction. So the details, as with other EPR programs, extended producer responsibility programs, we will work these out with a combination of DTSC and Cal recycle and stakeholders. But the idea is, if it is economically beneficial to do it in state, do it safely, you're going to do a lot to safeguard the environment, other jurisdictions.
Person
All right. Seeing no other questions or comments, would you like to close?
Person
All right, we have taken testimony, questions, and we have a quorum. Does someone want to make a motion?
Person
We have a motion. It is a do pass recommendation. Mr. Secretary, please call the roll.

Person
Hello, my name is Gloria Carolina Chong. I'm an attorney with the Family Violence Appellate Project. We are a proud co sponsor of SB 662, along with the Legal Aid Association of California. And I'm here today on behalf of over 35 domestic violence and legal services organizations to urge your aye vote on this Bill. Through our work. We hear every day that there is a court reporter shortage, and it is directly affecting the safety of survivors of abuse.
Person
This shortage stems from the lack of enough court reporters to handle depositions, private trials, arbitrations and court hearings. No labor representative testifying today could tell you that any court reporters lack adequate or well paid work. Nor will any private shorthand reporter stand up to tell you that they want to leave their private career to go work for a court.
Person
SB 662 addresses the court reporter shortage crisis by permitting courts to turn on electronic recording equipment that they have when a court reporter is not available for civil hearings. According to the judicial counsel, 46% of the courtrooms in the state's largest courts already have electronic recording equipment, and this Bill will let courts create a record for a long list of cases that are entitled to one that are not entitled to one.
Person
Under this Bill, courts may also choose to purchase additional electronic recording equipment with their existing budgets. But the Bill also prohibits courts from using the equipment to replace any court reporter. The opposition to this Bill won't discuss the expense to the courts and the State of California when Low and moderate income people have to return to court month after month in the hopes that a court porter is available for their case.
Person
They also won't tell you about the devastating economic and other effects when survivors cannot appeal wrong and dangerous decisions that often lead to homelessness for them and their children. With economic ripple effects throughout the state, any cost associated with preventing these tragedies is well worth it. Please help stop this crisis with your. I vote for this Bill.
Person
Thank you. Any other support? Seeing no other support. Opposition.
Person
Hi, pardon me. I'm Tamara Houston. I'm a court reporter and I'm currently the President of the California Court Reporting Association. We strongly oppose SB 662. It's much more effective to hire court reporters in courtrooms, the proven gold standard with the $30 million that the Legislature has previously allocated and is on an ongoing basis to fulfill this purpose.
Person
Good afternoon, Mr. Chair Members. Ignacio Hernandez, on behalf of the United Public Employees Union, representing court reporters in a variety of counties, including Sacramento. Very briefly, just based on the support comments I think it's important I comment as a labor organization. Let me be very clear. Courts have been deliberate in not hiring court reporters. This Legislature allocated $30 million ongoing to hire, retain and recruit court reporters.
Person
And I can tell you in Sacramento county, as an example, the union had to fight to get the court to actually request that money from judicial counsel and then push them to actually use it. And when they did, there was a waiting list to get people hired. That has been happening in a handful of counties where the courts have actually tried to use the money.
Person
So we can actually fix this alleged shortage if the courts actually took affirmative action to hire instead, the courts are supporting bills like this to go to electronic recording instead of spending the money. Only a fraction of the money has been spent. And also there are courts who have been laying off court reporters or shifting them out of family court to create the very problems that you just heard from the supporters.
Person
There is a way to change the management, spend the money that the Legislature allocated, and we can address this. Plus, there are students. I think 600-700 students are already on waiting lists ready to come into this profession. So we are well on track to do it. It's a matter of will, and that's why we are strongly opposed to this Bill. Thank you.
Person
Anyone else opposed? None. Moderator let's go to the phone line for support or opposition. We've heard from primary witnesses on both sides, so if folks on the phone line could just confine themselves to their name, organization and position, I'd appreciate it.

Good morning. This is Jamie Asbury, Court reporter and current President of Deposition Reporters Association of California. I strongly oppose California spending millions of taxpayer dollars to replace state certified and trained professionals with a proven inferior method as a short term fix. This supposed short term fix inherently will deter prospected individuals from entering the field of court reporting, thus furthering the crisis into the future.
Person
All right, if folks could just confine themselves to their name, their organization and their position. I'd appreciate it.

We'd respectfully like to request the one time $85 million appropriation to support California's unhoused youth who are on the cusp of graduating high school and starting adulthood. This program would follow the California GI Pilot Framework and would provide the 15,000 twelveth graders in California experiencing homelessness with monthly unconditional cash payments during the critical transition between high school and postsecondary education or employment.
Person
We know GI and tax credits work. There's a strong and consistent multiplier effect with almost $2 for every dollar invested. And this stimulus not only helps the recipients, but also the local economy, because the money is spent there almost immediately. Our one time investment will have a lifelong impact on these youth and will help prevent 15,000 young adults in California from graduating into adult homelessness. Thank you for your time.

Legislator
Thank you, Mr. Chair. Senator Pontino, a quick trivia question for you, sir. In 2021, what percentage of K 12 classes were taught by a teacher without the appropriate credential or training for the course? What percentage?
Legislator
And I just want to address some of the concerns brought by CTC on the SBA 11. SBA 11 would enter California into the Teacher Interstate Teacher Mobility Compact, which will allow teachers moving from one Member state to another to be granted the closest equivalent license to their current credential. The CTC states that the increase in out of state applications would result in the need for four new positions at the CTC costing $400,000 per year.
Legislator
However, this dollar amount, $400,000, does not take into account the money that will be saved to the streamlining of the application process, which is the point of the Bill. Although there would be an influx of applicants, hopefully to fill that 17%, each application will require far fewer person hours than is currently necessary.
Legislator
I'm greatly appreciative that the CTC is so confident in the efficacy of this Bill and the compact that they think that they will need four whole new positions to take on the new applications of teachers coming into our state. I think that's a good thing, worth the expense. Also with me today, Mr. Chair, is Ned McNeely from the Marine Corps, who is helping with the Bill.
Person
Good morning, Ned Mckinley. Good afternoon. With the Marine Corps. Just R1. Quick comment about the Bill. All the evidence from compacts in other states. It streamlines the processes for getting licenses. It will reduce, at least in some ways, in a less workload for the CTC with all these prescreened applicants from other states. So just that one comment to emphasize. Thank you.
Person
Thank you. Any other witnesses in support? Seeing none. Any opposition to 811? Seeing none. Let's go to the phone line.

And, Mr. Chair, we have no one else in queue wishing to speak at this time.
Person
All right, we've taken support and opposition of 829 without objection. We will go to suspense with that Bill. SB Eight. Eight. Our final Bill Glazer on Political Reform Act. It's a suspense candidate. It's, I guess, a Committee Bill. Suspense candidate. We'll open up the public hearing. There's nobody here in support. Any opposition? No opposition. Let's go to the phone line.
Person
And if you wish to speak in support or opposition, please press one, then zero at this time. And we'll go to line 181. Please go ahead. I'm sorry. Line 181, please go ahead. It looks like they removed the stuff from queue. Just a moment. We have no one in queue wish to speak at this time.
Person
All right, we've taken support and opposition of eight. Eight. Eight. Seeing none, we have no questions or comments from the DeUs. Without objection. Eight. Eight will go to suspense. We have one Bill on call, SB Five. Six. Eight. Please call the absent Member.

One more thing. One more trivia question. All right, one more trivia question. This should be a softball for either of the Senators.
Legislator
This is May eigth. In the history of May eigth, four significant things have happened, three of them regarding war, one of them regarding arts and entertainment. Can you name two of the four major things that have happened on this day in history?
Legislator
But we could have an approach hearing on my birthday, so I will bring that up. Two of the four major things on May eigth.
Legislator
Two biggest, in my opinion, are the Beatles released their last studio album on this day after the breakup of the band, by the way. I will add. And then this is also VE Day victory, end of World War II in Europe.
Person
There you go. Well, thank you, Dr. Jones. That concludes our business for the day. Continue to bring your comments forward. You can send them in writing. You can participate in our agenda. And we appreciate all of the staff and Members for participating, and we are adjourned.
