Senate Standing Committee on Appropriations

The Senate Committee on Appropriations will now come to order. We are holding our hearing Today in room 2200 of the O Street Building. The Business and Professions Committee is currently meeting across the hall. And so we'll see some Committee Members going back and forth between the two committees.

So if you see people get up, they're not leaving because it's not important. They will be back. We have 63 measures on today's agenda, all but one of which are suspense file candidates. There are four bills still listed in the daily file that will not be heard today.

So if you're here for these, they will not be heard today. SB432, Senator Seyarto, SB544, Senator Laird, and SB555 by Senator Caballero were all pulled from the agenda and will be rescheduled for a later hearing. SB671 by Senator Cervantes will be sent directly to the Senate Floor.

Pursuant to Senate Rules 28.8, the authors for all of the suspense measures on today's agenda have waived presentation. What that means is that the authors of the Bill will not be here to talk about the Bill. As usual, however, we will be taking testimony from the public on each and every item.

The reason that the authors will not be here is this is not a. This is about the budget, not about the merits of the Bill. Before we begin, I want to remind any witness to limit their testimony to the fiscal aspects of the Bill. In other words, how much it will cost.

Please refrain from lengthy policy discussions and repeating prior testimony in your comments. Before we begin to hearing testimony on the measures, let's establish a quorum. Madam, assistance, please. Please. Assistant, please call the roll.

A quorum has been established. Now we can move on to the business of the day. We're going to take up the one file that we need to hear, and I will pass the gavel over to the Vice Chair.

Okay? So right now we're going to be taking up the Chair's Bill, which is SB251. And this is eligible for a do pass motion. Madam Chair, tell us about your Bill.

Thank you very much. Members. SB 251 is the first of two claims Bill carried by the Chair of the Appropriations Committee each year to provide appropriation authority for legal judgments and settlements.

Approved by the Department of Justice and the Department of Finance, this urgency Bill appropriates approximately 1.2 million from the General Fund to the Department of Justice for the payment of attorneys fees and costs for the following claims against the state, State First Amendment Coalition versus Bonta, Linton versus Bonta, and X Corporation versus Bonta.

These judgment, judgments and settlements are Biden binding state obligations. It means we got to pay them. Any funds approved in excess of the amounts required for the claims will revert back to the General Fund. With me today are Justin Rosa and other representatives from the Department of Justice who can answer any technical questions about the individual claims. And I respectfully ask for your aye vote.

Morning, Mr. Chair. Members, Justin Rausa, the Deputy Director of Legislative Fiscal Policy, proud to speak on behalf of the sponsor, Attorney General Bonta. We appreciate Senator Caballero for her continued partnership on the claims bills and the chief consultant for the detailed analysis. So as not to repeat, Senator Caballero, this claims Bill appropriates $1,221,491.30 from the General Fund.

And with me today, in case Members have any specific questions, we have Deputy Attorneys General Bree Boutine, Jerry Yen, and John Echeverria. Should you have any questions with that, respectfully request your aye vote. Thank you.

Good morning, Mr. Chair. Christian Beltran with the Department of Finance just here to say that Finance is. In support of the Bill and as noted in the Committee analysis, has also approved all three settlements. So I'm also here to answer any questions that you.

Thank you. Thank you very much. Is there anybody else in the room who is in favor of this that wants to come up and say, me too? There being none, will go to opposition. Are there any opposition witnesses that wish to be? No, doesn't look like it. Anybody in the audience want to come up and oppose?

I kind of do, but that's. All right. All right. We're going to bring it back to the dais at this time. zero, Department of Finance, was that your report? That was it. Perfect. We'll bring it back to the dais. Anybody have questions or concerns about this?

Okay, we have a motion to move the Bill, but I am going to make some comments about this. We're about to spend $1.2 million, and I'm glad the people are here to answer questions we have on the Linton case. This is a loser case from the very beginning.

It went all the way to our Supreme Court and lost. And we're paying $617,000 of hard earned taxpayer money for this case. My position is that we should be letting the DOJ figure out where they're going to get their funds from their budget, not the General Fund to pay for a wasted case like this.

This was not hard, and neither was the second one. The X Corps one was unconstitutional from the very beginning, and it lost. And there's. That was another 244. No, that was $359,000 of taxpayer money that we're going to pay out because we went on something that. I can't understand how our lawyers don't know that this is unconstitutional.

Everyone else did. That's why I voted against this Bill. So these payouts keep coming every year. I know we have to pay them now because there are bills, but I think there are other ways to pay this.

And I think when we have an agency that is so irresponsible in their pursuit of an obvious case that we shouldn't be going into the General Fund to pay for this. They should find it in their budget. I know they have the money there.

They took $1.0 billion, gave half of it back to the General Fund, but they put it into a special Fund that could have been used for something like this. So we need to do something to ensure that going forward we're not encouraging ridiculous suits like this because we don't deserve to have to pay for that.

So that's my comments. I will be voting no on it. And with that, Madam Chair, would you like to close?

Thank you very much, Mr. Vice Chair. So let me just say that I appreciate your comments, but it's an oversimplification of the way that we do business here at the state. State bottom line is anybody can sue the state for any purpose. And that's true in the business community as well.

Businesses get sued, they have no option but to defend themselves. And sometimes you win and sometimes you lose. And when you lose, then you have to pay the attorney fees of the entity that sued you. You don't want to. It's not something that you want to have to deal with, but it's required.

The bottom line is that this is the way that we process these kinds of claims. These defenses were defenses that had to be posited because the Legislature passed legislation. We were trying to do good things, and in the end, the courts disagreed on some issues and they agreed on some issues.

So we won some of the motions that were. Were filed in these cases, and we. And we lost some of them. But in the end, we. The. The negotiation was to pay the attorney's fees. To agree on what the attorney's fee should be. And that's why it's here today before us. So I respectfully ask for your aye vote

SB29. Okay, so why don't you tell us that's Laird Bill. And what we're going to do is have you tell us your name and give us your information.

Okay. My name is Antonio Mares and. Good morning chair and Members. I'm here to speak in strong Support of Bill 29 not only as a father who lost her daughter to medical negligence, but as someone who understands the deeper financial impact this Bill represents. SB 29 is about justice, but it also carries smart long term fiscal responsibility.

When families like mine are denied access to civil justice, we're often left turning a public system to support mental health care, counseling, State Fund funded services because there is legal accountability place on those responsible that shifts in financial burden from the negligent parties of taxpayers. By allowing non economic damages and wrongful death cases.

SB 29 creates a system that promotes accountability and deteriors negligence which ultimately reduces repeat offenses, future lawsuits and long term costs to the state. The Bill does not open the door to excessive legislation and simply closes the loophole to the current protects wrongdoers from consequences while burning families and the public with the aftermath.

I know there's much more to be said, but I believe this is the time where a lot of things are coming out to the light.

And I believe this is the time where a lot of cases like mine need to come out of this rug because they just keep getting tucked into the rug year by year after this situation happening to me, my, my wife, my son, not only did they lost my daughter, but I almost lost my wife in the process.

So I strongly believe that after building a community, finding out that there's a lot more people like me and this is not fair. And I want to say thank you for here to highly support SB29.
