Thank you very much. Members. SB 251 is the first of two claims Bill carried by the Chair of the Appropriations Committee each year to provide appropriation authority for legal judgments and settlements.

Approved by the Department of Justice and the Department of Finance, this urgency Bill appropriates approximately 1.2 million from the General Fund to the Department of Justice for the payment of attorneys fees and costs for the following claims against the state, State First Amendment Coalition versus Bonta, Linton versus Bonta, and X Corporation versus Bonta.

These judgment, judgments and settlements are Biden binding state obligations. It means we got to pay them. Any funds approved in excess of the amounts required for the claims will revert back to the General Fund. Okay, we have a motion to move the Bill, but I am going to make some comments about this. We're about to spend $1.2 million, and I'm glad the people are here to answer questions we have on the Linton case. This is a loser case from the very beginning.

It went all the way to our Supreme Court and lost. And we're paying $617,000 of hard earned taxpayer money for this case. My position is that we should be letting the DOJ figure out where they're going to get their funds from their budget, not the General Fund to pay for a wasted case like this.

This was not hard, and neither was the second one. The X Corps one was unconstitutional from the very beginning, and it lost. And there's. That was another 244. No, that was $359,000 of taxpayer money that we're going to pay out because we went on something that. I can't understand how our lawyers don't know that this is unconstitutional.

Everyone else did. That's why I voted against this Bill. So these payouts keep coming every year. I know we have to pay them now because there are bills, but I think there are other ways to pay this.

And I think when we have an agency that is so irresponsible in their pursuit of an obvious case that we shouldn't be going into the General Fund to pay for this. They should find it in their budget. I know they have the money there.

They took $1.0 billion, gave half of it back to the General Fund, but they put it into a special Fund that could have been used for something like this. So we need to do something to ensure that going forward we're not encouraging ridiculous suits like this because we don't deserve to have to pay for that.

Thank you very much, Mr. Vice Chair. So let me just say that I appreciate your comments, but it's an oversimplification of the way that we do business here at the state. State bottom line is anybody can sue the state for any purpose. And that's true in the business community as well.

Businesses get sued, they have no option but to defend themselves. And sometimes you win and sometimes you lose. And when you lose, then you have to pay the attorney fees of the entity that sued you. You don't want to. It's not something that you want to have to deal with, but it's required.

The bottom line is that this is the way that we process these kinds of claims. These defenses were defenses that had to be posited because the Legislature passed legislation. We were trying to do good things, and in the end, the courts disagreed on some issues and they agreed on some issues.

So we won some of the motions that were. Were filed in these cases, and we. And we lost some of them. But in the end, we. The. The negotiation was to pay the attorney's fees. To agree on what the attorney's fee should be. And that's why it's here today before us. So I respectfully ask for your aye vote

I'm here to speak in strong Support of Bill 29 not only as a father who lost her daughter to medical negligence, but as someone who understands the deeper financial impact this Bill represents. SB 29 is about justice, but it also carries smart long term fiscal responsibility.

When families like mine are denied access to civil justice, we're often left turning a public system to support mental health care, counseling, State Fund funded services because there is legal accountability place on those responsible that shifts in financial burden from the negligent parties of taxpayers. By allowing non economic damages and wrongful death cases.

SB 29 creates a system that promotes accountability and deteriors negligence which ultimately reduces repeat offenses, future lawsuits and long term costs to the state. The Bill does not open the door to excessive legislation and simply closes the loophole to the current protects wrongdoers from consequences while burning families and the public with the aftermath.
