ASSEMBLY THIRD READING
ATR Bill Id:AB 3302
Author:(Salas)
As Amended Ver:May 4, 2020
Majority vote
SUMMARY:
Ratifies provisions of a Memorandum of Understanding (MOU) between the state and state bargaining unit (BU) 6 (Corrections), represented exclusively by the California Correctional Peace Officer Association (CCPOA).
Major Provisions
None.
COMMENTS:
Legislative Consideration of State Bargaining Unit MOUs
Since the passage of a statewide ballot measure requiring a simple majority vote of each house (i.e., the Assembly and the Senate) of the Legislature relating to passage of the annual State budget, MOUs between a state bargaining unit and the State continue to be vetted and considered by the Legislature through the annual budgetary process via budget trailer budget bill.
According to the Author:
"Promoting full communication between the state and its employees by providing a reasonable method of resolving disputes regarding wages, hours, and other terms and conditions of employment is the state purpose of the Dills Act.
"The MOU between BU 6 and the state establishes an equitable procedure for dispute resolution establishing rates of pay, hours of work, and conditions for employment critical to the work of the state employees in corrections."
This is a spot bill that may be used to approve the final collective bargaining agreement reached this year between the state and BU 6. The current MOU is in effect from July 3, 2019, to July 2, 2020.
Arguments in Support:
According to the CCPOA, "A collective bargaining agreement provides the foundation for a harmonious relationship between the state employer and its workforce. Such agreements govern workers' rights and management's expectations of its workforce. [The] CCPOA represents nearly 30,000 correctional peace officers and parole agents who provide an essential service to the state of California. Everyday our members place their lives on the line to ensure public safety and to give offenders an opportunity to restore their own lives as well. In every MOU negotiation, we attempt to achieve a contract that is equitable to the taxpayer and most deserving of the sacrifices of our members put forth.
"A critical component to that is assuring that the state's workforce feels valued, appreciated, and safe when performing a very dangerous and volatile job"
Arguments in Opposition:
None on file.
FISCAL COMMENTS:
According to the Assembly Appropriations Committee, this bill would result in "unknown state costs."

SUMMARY:
This bill ratifies provisions of a Memorandum of Understanding (MOU) between the state and state bargaining unit (BU) 6 (Corrections), represented exclusively by the California Correctional Peace Officer Association.
FISCAL EFFECT:
Unknown state costs.
COMMENTS:
Purpose. This is a spot bill that the author says “may be used to approve the final collective bargaining agreement reached between the state and BU 6.” This committee generally moves forward MOU spot bills given the timeline of negotiations between the administration and the employee organization. However, because the ultimate details of the final MOU are unknown, costs cannot be determined and thus this bill is eligible for this committee’s Suspense File.
