Assembly Standing Committee on Accountability and Administrative Review
- Cottie Petrie-Norris
Legislator
Good afternoon and welcome to today's hearing on Accountability and Administrative Review. Before we begin, I'll just dispense with a couple of housekeeping announcements. First, to ensure that members of the media and the public have access to our proceedings today, this hearing will be streamed on the Assembly's website, and members of the public can provide testimony in person here in Room 437. To preserve the safety of everyone here and to ensure the public's access to the discussion, please follow the directions of our sergeants.
- Cottie Petrie-Norris
Legislator
If any member of the public in the room would like to testify on the bill, I will ask you to approach the microphone at the appropriate time. Lastly, I do want to acknowledge that the Assembly has experienced several disruptions to committee and floor proceedings in the last several years. We want to ensure that all voices are heard. However, conduct that disrupts, disturbs, or otherwise impedes this hearing is prohibited. Thank you in advance for your cooperation.

And with that, it looks like we do not yet have a quorum, but we can go ahead and begin as a subcommittee, as I see that our author is here. And again, just to share a little bit of context before we begin with Senator Dodd's comments, as stated in the Committee analysis, the bill that we'll be hearing today, SB 74, was double referred to our Committee and to the Assembly Committee on Privacy and Consumer Protection, which is chaired by our colleague, Assembly Member Gabriel.
- Cottie Petrie-Norris
Legislator
As a result of these two committees working together on Joint Committee amendments, yesterday the Rules Committee acted to update that referral to a single referral just for the Accountability and Administrative Review Committee. Thus, this bill will not be heard by Privacy Committee. And just important to emphasize that the amendments are the work product of our two committees working together, and an agreement with both committee chairs. And thank you to the staff as well as to Chair Gabriel of the Assembly's Privacy and Consumer Protection Committee. With that, Senator, when you're ready.

Thank you very much Madam Chair and members. I'd like to start by thanking the chair and staff committee, as well as the committee on privacy, for your collaborative work on this bill. I'm happy to accept joint committee amendments as described in comments 8, 9, and 10 of the analysis. I think you all know by know, SB 74 prohibits the download or use of high-risk social media applications on state owned or controlled devices.

I'm not gonna read all the prepared documentation because I know that you're familiar and, as chair and vice chair, and since the committee is not here to hear everything, I'll just kind of summarize it. This bill requires California state agencies to prohibit the use of social media app on their state devices, if that app is owned or controlled by an entity or country of concern. Countries of concern are defined to mean any country identified by the Federal International Traffic in Arms Regulations which includes, among others, China, Iran, North Korea, and Russia.

SB 74 is similar to actions already taken to protect government data in a majority of the states at the federal level as well as the armed forces. The proposed amendments bring the Bill into further alignment with those actions. I respectfully ask for your aye vote.

Thank you, Senator. Are there any primary witnesses in support? I do not believe so, no. Is there anyone in the room wishing to testify in support? Seeing and hearing none. Anyone in the room wishing to testify in opposition? Seeing and hearing none. Questions or comments from the committee?

I will simply just make a couple of comments before we turn it back to the Senator. So first, certainly appreciate your bill and support the state of California taking all appropriate steps to protect the security of our state's information technology and sensitive data of both the state of California and importantly, our California citizens. We must have clarity and accountability in our state policies and procedures to protect against risks from the use of social media platforms.

And as the Committee on Accountability and administrative review, we review legislation to first, ensure clarity in what a Bill is requiring a state agency to do, and second, to ensure that the Bill provides a means to hold the agency accountable for doing so. And it was that lens through which we engaged with the author's office in developing these amendments. So appreciate your accepting the committee amendments and do believe that the Bill as amended will take meaningful steps to the goal that you've articulated. So with that, Senator, would you like to close?
