    Good morning, Madam Chair and Members. I want to start by sharing that I will be accepting the Committee's amendments. And Today I'm presenting AB569, a Bill to help local governments recruit and retain a strong public workforce by giving them the option to negotiate supplemental pension plans for their employees. Across California, local governments are facing a real challenge.

    They can't hire and keep enough workers to fill critical jobs, from emergency services to sanitation to health care. We're seeing persistent vacancies, and that affects the services our communities depend on every day. A major driver of this problem is retirement insecurity, and that's where AB569 comes in.

    AB569 clarifies that a local public employer and a union representing its workers can negotiate contributions to a supplemental defined benefit plan. This Bill does not create new mandates. I want to be very clear about that. And it does not undermine PEPRA's core protections.

    It simply gives local governments and their employees another option at the bargaining table, one that might make the difference between losing or keeping a talented worker. We've worked closely with Committee staff to ensure the Bill stays narrowly focused, and I want to thank the staff for that.

    And at the Committee's request, we've amended the Bill to remove the word notwithstanding, which could have created unintended ambiguity. The amended language makes clear that any negotiated contributions must remain fully consistent with existing PEPRA limits.

    In a competitive job market, local governments need to be able to offer benefits that workers value, and they need to be able to do that in partnership with Labor. AB569 gives local governments that option, not the obligation, but to negotiate for stronger retirement security. With me today, I have Shane Gooseman with the Teamsters to testify and support.

    Yeah. Good morning, Madam Chair. I won't take all two minutes. This will be very quick. Shane Gusman, on behalf of the California Teamsters Public Affairs Council, this Bill is really about clarifying what can and can't be done with these plans.

    Existing pension plans that were grandfathered in during the enactment of pepra, we're mostly talking about the only ones that I know in existence are Taft Hartley plans that are managed by the union that represents the bargaining unit, and it would allow a small contribution to those plans. Allow the union to negotiate a small contribution to those plans.

    Right now there are grandfathering provisions in two different places in pepra. And as you can see from the analysis that was so thoroughly prepared, it's a little bit convoluted. And so the idea is to.

    To clarify it so we can make sure that employers and bargaining units understand that, yes, you can negotiate contributions to an existing plan going forward. And with that, we'd ask for your aye vote.

    In 1998, while I was still on tribal council, I introduced a Bill AB 1953, along with former Assemblymember Joe Bacus Sr. Which brought Native American Day into the mainstream of the educational system, calling on educational systems to teach about the factual sights and sounds of California's first people. 27 years later today.

    We are here today, moving forward on the next step in honoring California's First People With a Paid State Holiday California is home to more Native American people than any other state in the nation, with hundreds of tribes sharing their unique history on their traditional lands.

    However, there are still areas that are not acknowledged, are widely known or accepted in the State of California. California's first people's issues such as slavery, militias that were sent out to exterminate try to exterminate California's first people that was paid for by taxpayers dollars and reimbursed by the Federal Government to the State of California.

    These types of issues still have not resonate to where they need to be in the State of California. Atrocities that had left and still leave deep scars and trauma for many generations to overcome and that has continued to impact tribal communities to this day. Yet California's first people remain resilient and contribute to the State of California.

The work being done here today will help achieve the next step that we have set out to accomplish 27 years ago to finally establish California Native American Day as a paid holiday.     Formalizing this day as a paid holiday acknowledges that Native peoples matter, that our cultures, our presence, and our contributions to California are just as important as other communities. AB989 puts Native American Day on equal footing with holidays like Juneteenth, Lunar New Year and Genocide Remembrance Day, sending a clear message that California values diversity, inclusion and historical truth.

    Good morning, Madam Chair Members. A.B. 268 as Diwali is an official state holiday in California, and I'm proud to author it a long with our colleague, Assembly Member Patel.

    Diwali, a festival of great significance to Indian Americans and South Asian Americans and is celebrated annually by Hindus, Sikhs, Buddhists and Jains of all ethnic backgrounds throughout the United States and across the globe.

    The exact date of Diwali is determined by the 15th day of the month of Karthik and Hindu lunar new year, lunar calendar of each year. It's kind of like our lunar new year, right? And it does happen typically towards the end of October or early November.

    Even though California often leads in its diversity, we're not the first state to specifically recognize the value in its state laws. Last year, Pennsylvania became the first state to officially recognize the Valley as a state holiday. New York requires public schools in the City of New York to be closed on the Valley as a school Holiday.

    Other states are also considering similar recognitions through state measures, including Massachusetts, Nevada, Illinois, and Connecticut. The analysis does a thorough job explaining the broad approach taken with other cultural, religious, and heritage days. However, Diwali is also broad, is also broad and multicultural, and California is home to the largest population of Indian Americans and South Asians.

    And while I celebrate Lunar New Year, one of the things I've always brought forward was that growing up, it was always known as Chinese New Year. And that's what I would continue to call until I got older and I realized I'm not Chinese. And for us, we call it that. And so Lunar New Year encompasses every.

    All of us. However, in this situation, I love the fact that we can say that Diwali is something that we also celebrate as well, too, and it's being recognized, and it also is an opportunity for our community to learn about the different cultures and the different types of celebrations that we do here in our community. I really appreciate this opportunity to present AJR3 a resolution to send a strong message to Congressional leadership, California's Congressional delegation and the White House that Social Security, Medicare and Medicaid are foundational to our communities and that any cuts to these programs will only create irreparable harm.

    Social Security is our nation's most important source of retirement income, disability and life insurance. And for over 6 million Californians, including veterans and those who serve who those with severe work disabilities, the program provides monthly cash benefits and health insurance.

    We must remember that the Social Security system is one where those now receiving benefits paid into the system their entire working life on the promise that when the time comes, they would receive the benefits they were entitled to. This is very literally money that everyone has paid into and should receive back.

    Like Social Security, Medicare is also a critical lifeline to seniors and persons living with disabilities. The health care provided under Medicare makes sure that the population with the highest health care costs are provided care at a fraction of the administrative costs of private health care plans.

    Current federal proposals could change how care is delivered under Medicare and result in an increased health care security and cost for those who rely on it, especially our seniors. And finally, this AJR calls for our representatives to protect Medicaid or Medi Cal in California.

    For nearly 15 million Californians, including children and families, Medi Cal is their only source of health care, providing primary care services, dental and vision care and mental health care, substance use disorder services and long term care as well. Medi Cal is already caring for working people in our state, with 1 in 5 of all California workers enrolled.

    With me to speak today to support AJR3 is Hene Kelly, Vice President of the California Alliance for Retired Americans and Sherry Williams from SEIU Local 2015.

    Yes, ma'am. I am Henny Kelly. Proposed cuts to Social Security, Medicare and Medicaid will impact seniors as well as young people.

    It is impacting me because I lost my husband on November 72024 and I have been told that it will be an additional 180 to 240 days to get an appointment with Social Security to receive his death benefits and his Social Security. I am not alone in this.

    I have talked to people who have lost their houses and lost their everything because it didn't work. Cara does outreach, regardless of politics, and we let people of all ages know about laws that may impact them and how they can advocate. Retirees are scared. They're already struggling to afford their health care housing on a fixed income.

    If you get to be old like me, you'll likely have some disabilities. But Social Security is for disabled people of all ages. About 25% of Californians who receive Social Security are under 65. And Medi Cal covers more than half of all California kids. If we cut Medicare or Medicaid Medi Cal services, people will die.

    There will be more seniors and people with disabilities on our streets, young children on the streets. Emergency rooms will be swamped, making care more expensive for everyone. That's why I ask you to vote aye today on ajr. It is about decency and freedom.

    And the time has come for us to pass it on to the next generation and the generation after them. For my grandchildren, your grandchildren, their grandchildren, this is the right thing to do.

    Good morning, Committee Members. Thank you for holding this important hearing and considering AJR3, which I am here to support. My name is Sherry Williams. I've been a care provider for over 30 years.

    And in the 10 years I have worked for IHSS, I am here to share with you absolutely critical role that Medi Cal play plays in the lives of millions of Californians and to speak out against the proposal in US Congress to cut 801.0 million billion one point from Medicare.

    I have cared for approximately 15 people as an NIH care provider. Each one of them is valuable and an important part of their community. As a caregiver, I put myself in their shoes and ask them how I want to be treated, and that is the care I provide for them.

    I'm going to share a story of two people, both veterans, whom I cared for. Peggy, in her late 50s, has developed multiple serious health conditions that kept her homebound. She had severe respiratory issues Heart disease and extreme limited mobility. She became a prisoner in her own home. Without care, she soon would have had been institutionalized.

    Instead, IHS has allowed her to stay in her home and live in a life of great dignity. It has been her lifeline. Taking care away from her would be devastating. Not to mention the medical care that she relies on provided by Medi Cal Oxygen Medications, respiratory therapy and frequent Doctor visits. She served the country.

    She served this country. She contributed her to her community. And she is now in need of care. Something that could happen to any one of us. She doesn't deserve that. No one deserves that. Now let me tell you about Mack, another veteran. Someone who served our country and military and our state as a counselor in state prisons.

    He has now has dementia and became. I began caring for him when he is 90. Everywhere we went, Costco Church, everyone knew him in Modesto. He was a Member of this community. He graduated from the State of the University of Sacramento care. He would have been at grave risk of becoming lost or even having an accident.

    Common events for people with dementia without ihss. One of his children wanted how to quit their job. Who serves as an attorney in San Francisco. He had twin boys that both are criminal attorneys. So cutting this Bill $880 billion in Medicare and reducing the access to taking care away from Peggy and Matt.

    Good morning, Madam Chair and Members of the Committee. I'd like to start by thanking the Committee consultants for their work and would like to accept the Committee's amendments. Before I begin my remarks, I do want to share how this Bill came about.

    As many of us in the legislative body know, we have Select Committees and we have hearings, sometimes joint hearings, and this came out of a special hearing last year with the CSUF and UCS regarding some of the issues that have been highlighted in potential issues with employees that sometimes reporting is not moved forward or investigated and then you see a resignation.

    So with that I will make my remarks. I'm proud to present AB 1067, which upholds integrity within our public service system and strengthens accountability by closing a loophole that has allowed some public employees to evade consequences for serious misconduct. AB 1067 requires public employers to complete misconduct investigations even if the employee under investigation retires during the process.

    Well documented abuses have shown that some individuals use retirement as a shield to avoid accountability. And again, this too often has happened in some of our higher education systems. And many of these cases, investigations are quietly dropped and wrongdoing is never officially recorded.

    This Bill reflects the simple principle that if someone misuses their position of public trust, they should be held accountable, retired or not. Under current law, once an employee retires, there is no obligation for the employer to continue the investigation. This creates a troubling gap in oversight, allowing individuals to walk away before the facts are fully known.

    Even worse, without a completed investigation, there is often no documentation of misconduct to refer to law enforcement, regulatory bodies or oversight entities. AB 1067 ensures that misconduct investigations continue their natural conclusion even if the employee is no longer on the payroll. This is not about in punishing retirees or in creating unnecessary burdens for agencies.

    It is about ensuring justice for those who have been victimized and protecting the integrity of our public institutions. By requiring that investigations move forward, we ensure that appropriate findings can be referred to law enforcement or used to inform decisions related to pensions, public safety and transparency. AB 1067 is a common sense reform for our state and local government systems.

    That is not addressed in this Bill at this point.

    I would probably look into that too, because we have some spouses who are dependent on that retirement that are now getting taken for a choice that they did not make a decision on. I know we like to talk about supporting victims and I think that would be victimizing them.

But I know with almost 30 years in public safety and seeing that, I too also did not like that they did not continue the investigation. So I do like that part. But I just wanted to bring that up too. This is a cleanup Bill that makes various technical and conforming changes to existing laws regarding certain State employee pay and benefits and employer employee relations at the Santa Clara Valley Transportation Authority.

    This is a proposal that the Members of our HR Council have discussed for nearly six years. Because the noted flaw in hiring system for classified employees positions is not in place to keep bad actors out of school settings and keep students safe.

    School employers, despite the best efforts to conduct thorough background checks by conducting live scan, DOJ and FBI fingerprint checks and also calling known former employees lack information if the applicant does not disclose their full employment history or prior investigations for egregious misconduct.

    Our classified employees are essential to so many services and so many programs and they make important contributions to our students growth and well being. Unfortunately, some bad actors are able to stay in the school setting by changing employers. Upon termination or even when there's an investigation pending, they simply leave the school employer off their application.

    And because there's no record system, there's no way for a school to have a complete employment history for certificated employees. We have a system. This is a process for reporting employees. There's a process with a database for reference.

    As a matter of fact, the new AB25 34 has provided requirements that all former employees are contacted and all former employees are provided by every applicant. A statewide database with egregious misconduct information could also help expedite the background checks of the right applicants.

    Because we have more of a clear picture, AB 1233 will offer a critical tool to protect students and ensure their safety and well being is prioritized. I've yet to meet someone who isn't shocked that we don't have any system in place in the State of California for this purpose.

    Thank you, Mr. Chair. Members. AB 1383 makes limited revisions to the California Public Employees Pension Reform act, or pepra, to address recruitment and retention challenges among the state's first responders.

    15 years ago, and in order to stabilize the state's retirement system, the Legislature made significant modification to public employee retirement benefits, including the retirement formulas, the age of the retirement, and requiring public employees to contribute more to their own retirement benefits.

    While many of these changes to PEPRA are still necessary for the long term health of the retirement Fund, retirement formula reductions are a contribution factor to vacancies throughout the public sector in the state, especially with our first responders. AB 1383 does not grant retroactive retirement benefit increases or pension holidays.

    It does not change other necessary and appropriate pepra guardrails. AB 1383 only applies prospectively. Recognizing the ongoing challenges and dedication of our firefighters, police and the unique challenges and risks associated with the career as a first responder.

    AB 1383 represents our need to recruit and retain the next generation of the first responders needed to protect the lives and property of residents across California. And today I have with me Brian Rice, President of the California Professional Firefighters, and Lamont Nguyen, President of the Long Beach Firefighters Local 372.

I represent over 35,000 firefighters and emergency medical personnel throughout California. I served nearly 30 years as a firefighter right here in Sacramento.

    And serving my community as a firefighter was absolutely the best career. It's the best career I could have asked for. I'm proud and I'm grateful for the work that I was able to accomplish on behalf of our community over three decades. And I wouldn't change it for anything.

    But the fact remains that with each passing year, we learn more and more about how dangerous this profession really is. Where heart disease used to be the most common affliction for firefighters, it's now unquestionably cancer. Each year, cancer takes more of my Members, colleagues and friends.     Pursuing a retirement age at 57. Every day spent on this job means more exposures to deadly potent carcinogens like diesel fuel, pfas, asbestos, benzene, hydrogen fluoride, off gases from electronics. As we're learning, lithium ion batteries, plastics in all forms.

    There are so many substances in mixed with fire that are so toxic to the body that it can't even name them all. Each day has a cost, and it's one that we pay for with our lives a little bit at a time.

    The jobs physically and mentally demanding in the extreme and asking us to work until we're 57 years old is pushing us not just to our limit, but beyond it. And I don't want to bury. I don't want to bury another friend before their time in the name of hypothetical cost savings. And that's what we're talking about here.

By lowering the retirement age of firefighters and other public safety officials to 55, this Bill takes a reasonable measured steps to balance both the security of the retirement funds and protect the health of the men and women who have stepped up to protect us all.

    I'm pleased to be here today and again, I don't want to be repetitive of the impactful comments of what President Rice has already said, but I would like to note as a firefighter who is subject to a formula with the normal retirement age at 57, I'm deeply concerned about how my body is going to handle the stress and the impact and exposures at 5556 and thus 57.

    With that said, I'd like to focus my comments on the importance of the provisions of this proposal that restore collective bargaining rights for employees when it comes to their retirement benefits. As this Committee knows, collective bargaining is critical to allow employees and employers to come together and coalesce on issues impacting wages, hours and working conditions.

    Current law limits our ability to bargain over critical issues like the employer and employee share of the normal costs and prospective changes in the retirement formula. As the President of a local, permission to bargain over these items does not guarantee that they will occur.

    But this will allow more me to better represent all of my Members, particularly the more than half of whom were hired after 2013 who are subject to these bargaining limitations. AB 1383 restores collective bargaining rights in a manner that doesn't make any affirmative decisions, but does give us all room to discuss at the table.     AB1383, though, however, is currently drafted, threatens to reverse over 15 years of critical pension reform designed to protect the long term viability of PERS's retirement system.

    The PEPRA enacted in 2013 was the result of careful planning aimed at stabilizing a system that was on the brink of unsustainability, largely due to the generous retirement enhancements granted during the 2000s. Returning to those benefit structures would severely compromise the future of health of PERS.

    Today, cities and counties are already allocating millions annually to cover the existing pension obligation. For the City of Salinas, we have over $11.4 million that we pay annually into PERS. That's over 8% of our budget. This Bill in its current form will not resolve staffing shortages as you saw present today.

    Instead, it will drive up pension costs which will likely result in fewer available dollars for salaries and direct services. In effect, this could actually hamper recruitment efforts rather than support them. We all share the goal of strengthening our workforce by improving recruitment strategies and offering competitive salaries.

    By working collaboratively with our unions, our local schools and colleges, we can continue to attract and retain talented public safety professionals. I commend the author's intent to enhance public sector hiring. However, salary remains the most influential factor when individuals choose an employer. But public service is a calling as well.     AB1383, if passed, will strain cities ability to offer competitive wages and healthcare benefits. More alarmingly, it could undermine the very retirement our system our employees are counting on to be there in their future. Given the current economic uncertainty, this proposal is especially risky.

    PERS recently suffered a loss of $15 billion due to the market volatility costs that will inevitably be passed on to cities already contending with shrinking revenues and increasing expenses to maintain essential services.     The reforms brought by PREPA have been instrumental enabling cities to continue providing vital services including police and fire, and allowed us to be competitive salaries.     There are strategies that we could implement that will protect our firefighters' retirement plans that they absolutely so deserve. And I want it to be there for them. And counties like mine are fully committed to recruiting and retaining strong public safety workforce. A strong public safety workforce. We're actively exploring solutions to address workforce shortages in law enforcement, EMS, fire and healthcare.

    But AB1383 moves in the wrong direction. This Bill rolls back hard-won reforms the Public Employee Pension Reform Act of 23rd, of 2013, and reinstates benefit formulas we already know are unsustainable. In the 1990s and the early 2000s, similar pension packages nearly bankrupt at this state and many of our local municipalities.

    We don't need to test them again. We've lived with the consequences. Since 2010, Santa Barbara county has paid over $100 million annually in additional payments to stabilize this retirement system. Sacrifices that brought our funded status from 62% up to 87%. But those payments came at real costs.

    Reductions to pay public safety staffing and fewer resources to address mental health, homelessness and criminal justice reform. It's hard to recruit when we can't afford competitive salaries. But worse than low pay is an unsafe working environment caused by constant overtime burnout and insufficient staffing. The result of budgets stretched in by rising pension costs.

    This Bill would send us further in that direction by allowing employers to adopt optional benefit tiers like 3% of 55 negotiating below the 50-50 cost share. And AB1383 creates a new arms race between municipalities. The ones most hurt will be those socially economically disadvantaged communities, those least able to afford this race to the bottom.

    So there isn't that option for either law enforcement or public safety. So that could be something that should be thought of and could be included. So rather than 57, they could retire as long as they're vested similar to us in five years less, that could be an option. I think it's not just the age.

    And we already do have the right to bargain with our unions over picking up the employer, picking up the employee portion. We, we have that right and I know we do do that.

    A lot of cities have been forced to go ahead and, and pick up more of the employees portion because of the competitiveness of that, of the nature. So that piece is a little bit, we already have that right. And finally, you know, the opportunity to contribute to defined contribution plan is also there as well.

    Okay, great points. Not every retirement system in California has that same motto. I want to attest to that. I actually left earlier for mine. I was a classic employee, so was able to take the percentage hit but still made it worth it to get out and do what I'm doing today.

    So I see where you guys are coming from. I, I have a son who's in law enforcement as well, who's also under PEPRA or who is under PEPRA.

    And so I feel for him and all those that came up and those that fall under PEPRA who with this Bill will at least possibly get the chance to get two years of their lives back. I probably would have made it a lower age, but I think 55 is pretty fair, at least a good start.

    So I see your points, but I'm definitely very supportive of this Bill and I am thankful that we are looking out for our first responders who do put their life on the lines every day, and that we are showing that we appreciate them by at least giving them some life back to them, with them, to enjoy retirement and maybe some time with their family as well.

    Thank you. Do you have anybody else who would like to weigh in? Because I am going to make some remarks myself. I think that this is a very delicate issue. I understand affordability, but I also understand the unique nature of first responders.

    Having had a career in law enforcement, I've seen the reality that one of the things you balance with these chosen careers is not just cumulative impacts of the job, but immediate threats. The immediate threats are very real and that makes this profession, these professions, very unique.

    I will tell you that I've been at the scene of very tragic circumstances. And so the reality of this profession impacts me a little differently than some people. It's not dollars to me, it's bodies, its people, its relationships. August 31, 2009 I was at the scene of a very long term memory of mine.

    Legislator

    It will never go away. Where they brought up the remains of two firefighters who lost their lives in a tragic firefighting event. Captain Steve Hall and Arnie Quinones, the firefighter. That reality kind of shifts my focus because those people will not collect any retirement and they did fund it. Certainly there's not enough to balance that out financially.

    But the reality of what that means needs to be thought about, needs to be carefully thought through, that these immediate threats often get forgotten. And we think about the cumulative impacts and how strong is somebody, if they reach that age, some of these tragic circumstances.

    I went to two funerals this month of law enforcement officers who lost their lives. They were in their 30s. That's a reality that doesn't become part of the discussion that needs to be thought through. And so, because I think your concerns are not misplaced, they are real and there's something to be thought about.

    But the reason why I support this is because it's not like, I mean, we saw the big long line of people here today that was not meaningless. But what's more meaningful to me is the realities of this unique pathway. You know, service does come from the heart, as was stated earlier.

    But with these unique threats, they stop that heart. And that needs to be thought about. So I am in support of this Bill and your free to close.

    Thank you, Mr. Chair. I did this Bill because I really do support the lives of these first responders. I understand budget, you know, what you're going through as administrators and looking out for county departments, but these are lives. These are people who show up for us.

    In Los Angeles, we just had one of the biggest fires we've ever had in the history of Southern California. And to see the lines of all these guys showing up and men and women, this is how they showed up for us when we had this disaster, like, never ending.

    Just people after firefighters, after firefighters, after police officers, after first responders. They saved our lives as well. And they put their lives on the line, and so they deserve to have this. So we have to figure it out. But I would love to talk to you. My door is never closed.

    I'm always willing to speak with people because I think if we get in a room and talk to each other, we can come to some kind of agreement that makes us all happy.

    But I also, you know, I did this because I really, truly respect these first responders and how they put their lives on the line for us. And with that, I'll ask for your aye vote. Thank you.
