Assembly Standing Committee on Public Employment and Retirement
- Tina McKinnor
Legislator
Good morning and welcome to the public and Members to the Assembly Committee on the Public Employment and Retirement. Before we begin, I have several announcements. File item 33 AB 912 Wilson is proposed for consent. File item 5, AB 1054, Gibson has been pulled by the author.
- Tina McKinnor
Legislator
File item 8, AB 1323, Chin has been pulled by the author and File item number 10 AB 1439 Garcia has been pulled by the author. For this hearing, we'll be limiting substance testimony to two primary witnesses on each side of the Bill and each will have two minutes.
- Tina McKinnor
Legislator
All others may only state their names, organization, if any, and position on the Bill. As a reminder, primary witness in support must be those accompanied with the author or who otherwise have registered a support position with the Committee. And the primary witnesses in opposition must have their opposition registered with the Committee.
- Tina McKinnor
Legislator
All other support and opposition can be stated at the standing mic and we'll call upon to simply state your name, affiliation and position for Committee Members.
- Tina McKinnor
Legislator
Since our hearings are public and some travel far to be here in respect for them and the author, please allow the author to complete their opening remarks regarding the bills before making a motion so the public has an idea of what the Bill is about and why it is proposed.
- Tina McKinnor
Legislator
If a motion is made during the author's opening remarks, I'll simply say that the motion will be recognized at the appropriate time for authors. You'll note that our hearing is publicly noticed as file order. Your staff should be monitoring this hearing to assist you with coming at the appropriate time to present your Bill.
- Tina McKinnor
Legislator
I see that some Members are already here. Finally, the Assembly has experienced a number of disruption to Committee and floor proceedings in the last few years because we seek to protect rights of all who participate in the legislative process and can effectively deliberate on critical issues facing California so that everyone is absolutely clear.
- Tina McKinnor
Legislator
Conduct that disrupts, disturbs or impedes the orderly conduct of this hearing is prohibited. We will not accept such behavior or behavior that incites or threatens violence. To address any such conduct, I will direct the individual to stop and warn them. If they continue, they will be removed from participating in this hearing or from the Capitol.
- Tina McKinnor
Legislator
And we will temporarily the hearing if necessary so that the sergeants who are sworn officers can restore order. Hopefully it will never come to that. Thank you in advance. Members, we need to establish a quorum. Madam Secretary.
- Tina McKinnor
Legislator
Members, let's take up the consent calendar. Is there any Committee Member who wishes to remove AB912 Wilson? From the consent calendar motion hearing. We had a motion by Nguyen and a second by Lackey. Madam Secretary,
- Tina McKinnor
Legislator
Thank you. Where's my order? Let's see who's here first. AB 569. Assembly Member Stephanie, you can start with Ready when you're ready. Thank you.
- Catherine Stefani
Legislator
Good morning, Madam Chair and Members. I want to start by sharing that I will be accepting the Committee's amendments. And Today I'm presenting AB569, a Bill to help local governments recruit and retain a strong public workforce by giving them the option to negotiate supplemental pension plans for their employees. Across California, local governments are facing a real challenge.
- Catherine Stefani
Legislator
They can't hire and keep enough workers to fill critical jobs, from emergency services to sanitation to health care. We're seeing persistent vacancies, and that affects the services our communities depend on every day. A major driver of this problem is retirement insecurity, and that's where AB569 comes in.
- Catherine Stefani
Legislator
AB569 clarifies that a local public employer and a union representing its workers can negotiate contributions to a supplemental defined benefit plan. This Bill does not create new mandates. I want to be very clear about that. And it does not undermine PEPRA's core protections.
- Catherine Stefani
Legislator
It simply gives local governments and their employees another option at the bargaining table, one that might make the difference between losing or keeping a talented worker. We've worked closely with Committee staff to ensure the Bill stays narrowly focused, and I want to thank the staff for that.
- Catherine Stefani
Legislator
And at the Committee's request, we've amended the Bill to remove the word notwithstanding, which could have created unintended ambiguity. The amended language makes clear that any negotiated contributions must remain fully consistent with existing PEPRA limits.
- Catherine Stefani
Legislator
In a competitive job market, local governments need to be able to offer benefits that workers value, and they need to be able to do that in partnership with Labor. AB569 gives local governments that option, not the obligation, but to negotiate for stronger retirement security. With me today, I have Shane Gooseman with the Teamsters to testify and support.
- Shane Gusman
Person
Yeah. Good morning, Madam Chair. I won't take all two minutes. This will be very quick. Shane Gusman, on behalf of the California Teamsters Public Affairs Council, this Bill is really about clarifying what can and can't be done with these plans.
- Shane Gusman
Person
Existing pension plans that were grandfathered in during the enactment of pepra, we're mostly talking about the only ones that I know in existence are Taft Hartley plans that are managed by the union that represents the bargaining unit, and it would allow a small contribution to those plans. Allow the union to negotiate a small contribution to those plans.
- Shane Gusman
Person
Right now there are grandfathering provisions in two different places in pepra. And as you can see from the analysis that was so thoroughly prepared, it's a little bit convoluted. And so the idea is to.
- Shane Gusman
Person
To clarify it so we can make sure that employers and bargaining units understand that, yes, you can negotiate contributions to an existing plan going forward. And with that, we'd ask for your aye vote.
- Tina McKinnor
Legislator
Thank you. Are there any in support? Please come to the mic. State your name, organization and position Committee.
- Yvonne Fernandez
Person
Yvonne Fernandez with the California Labor Federation in support.
- Tina McKinnor
Legislator
Thank you. Seeing no more. In. In support. Are there any in opposition? Please come to the front. Seeing none. No one in opposition. Anyone like to speak at the mic? In opposition? Seeing none. I'll bring it back to the dais. Any Member have any questions or any comments? Second, I'm seeing none.
- Tina McKinnor
Legislator
The Bill was moved by Assemblymember Berner and seconded by Assemblymember Nguyen. Madam Secretary, please call the roll. I'm sorry, would you please like to close? I went too quick.
- Catherine Stefani
Legislator
Sure. I just want to thank the Teamsters for their partnership. My great grandfather and my brother was a Teamster. So very happy to have them here with me today. And I respectfully asked for an aye vote.
- Tina McKinnor
Legislator
We have sufficient votes. We'll place it on hold. Thank you. Next we'll have Assembly Member Ramos. AB 989. We. We'll take that at the appropriate time. Thank you, Assembly Member.
- James Ramos
Legislator
Thank you so much, Madam Chair. Thank you, Members, for your motion. And second, today I want to thank the Committee also for. I know looking at the language of what brought us here today is very much intense in history in the State of California.
- James Ramos
Legislator
In 1998, while I was still on tribal council, I introduced a Bill AB 1953, along with former Assemblymember Joe Bacus Sr. Which brought Native American Day into the mainstream of the educational system, calling on educational systems to teach about the factual sights and sounds of California's first people. 27 years later today.
- James Ramos
Legislator
We are here today, moving forward on the next step in honoring California's First People With a Paid State Holiday California is home to more Native American people than any other state in the nation, with hundreds of tribes sharing their unique history on their traditional lands.
- James Ramos
Legislator
However, there are still areas that are not acknowledged, are widely known or accepted in the State of California. California's first people's issues such as slavery, militias that were sent out to exterminate try to exterminate California's first people that was paid for by taxpayers dollars and reimbursed by the Federal Government to the State of California.
- James Ramos
Legislator
These types of issues still have not resonate to where they need to be in the State of California. Atrocities that had left and still leave deep scars and trauma for many generations to overcome and that has continued to impact tribal communities to this day. Yet California's first people remain resilient and contribute to the State of California.
- James Ramos
Legislator
It's okay, take your time. The work being done here today will help achieve the next step that we have set out to accomplish 27 years ago to finally establish California Native American Day as a paid holiday. With me today is Calvin Hedrick on behalf of California Native Vote Project. Thank you.
- Calvin Hedrick
Person
..., Calvin Hedrick I am Mountain Maidu and I am a community organizer with the California Native Vote Project and good morning Chair and Members of the Committee. I am here today on behalf of CNBP to express our full support and proud sponsorship of Assembly Bill 989 introduced by Assemblymember Ramos.
- Calvin Hedrick
Person
AB989 proposes a long overdue recognition making California Native American Day, observed on the fourth Friday of September, an official paid state holiday.
- Calvin Hedrick
Person
While this has been recognized symbolically, we would like to make sure that it finally has the same standing as other state holidays, honoring the contributions and sovereignty of Native peoples not just in word but in practice.
- Calvin Hedrick
Person
California Native American Day is not only a celebration of our resilience and survival, but also recognition of our deep and enduring role in shaping the past, present and future of this state. For Native communities, it's a day of cultural importance, one that reflects both the beauty of our traditions and the trauma of our history.
- Calvin Hedrick
Person
Formalizing this day as a paid holiday acknowledges that Native peoples matter, that our cultures, our presence, and our contributions to California are just as important as other communities. AB989 puts Native American Day on equal footing with holidays like Juneteenth, Lunar New Year and Genocide Remembrance Day, sending a clear message that California values diversity, inclusion and historical truth.
- Calvin Hedrick
Person
As an organizer who works closely with Native youth and communities across the state, I Can tell you this. Visibility matters, recognition matters and leadership matters. We are especially proud to support this Bill because it is authored by Assembly Member Ramos, the first California Native American elected as state Legislature and a powerful voice for our communities.
- Calvin Hedrick
Person
We believe that AB989 is not just a policy decision, it's a moral one. It's about correcting disparities, honoring Native voices and helping to heal the wounds that still affect our communities today. And it's about creating space for Native people to gather, to teach and to celebrate without needing time off to ask for time off to do so.
- Calvin Hedrick
Person
On behalf of the California Native Vote Project, I thank Assemblymember Ramos for his leadership and urge the Committee to pass AB989 and take this meaningful step towards justice and equity. Thank you.
- Tina McKinnor
Legislator
Thank you. Can I please have folks who want to speak in support? Please give your name, organization and your position. Thank you, Madam Chair.
- Scott Govenar
Person
Scott Govenar on behalf of the Morongo Band of Mission Indians, in support.
- Frank Molina
Person
Thank you, Madam Chair. Members of the Committee, Frank Bolina, on behalf of Yohavyatham of San Manuel Nation and the San Ynez Band of Chumash Indians, strong support.
- Rocky Rushing
Person
Rocky Rushing, on behalf of the Society for California Archaeology and strong sport. Thank you.
- Unidentified Speaker
Person
Kimiko Hassler, Member of the Valley Tribe in support. Listening mvp Sequoia Coleman, Member of the Seminole Nation of Oklahoma Muskogee, in full support with the cnvp.
- Tina McKinnor
Legislator
Thank you. Are there any registered witnesses in opposition? Are there anyone that would like to come up and speak in opposition? Seeing none, I'll bring it back to the dads. Any questions or comments? Yes, Assemblymember Nguyen.
- Stephanie Nguyen
Legislator
Thank you, Madam Chair. I just wanna the Member for bringing this board. This is well, well overdue. And you are absolutely correct, sir, in saying that this aligns with some of the other holidays that we celebrate, like Juneteenth and Lunar New Year.
- Stephanie Nguyen
Legislator
But the significance it brings for you to bring this forward, for all of us to be able to vote on this and recognize the first people here in California, in our nation, is very meaningful to me. And hearing you express how passionately this means to you made me almost get emotional.
- Stephanie Nguyen
Legislator
Because I know how this is not just for you, but for your people and for all of us to be able to recognize, understand, learn and honor the people. So thank you so much.
- Stephanie Nguyen
Legislator
If I'm not added as a co author and if you're accepting co authors, I'd love to be added and wholeheartedly, happily honored to move this Bill.
- Tina McKinnor
Legislator
Would you like to anyone else? So for me, I would just like to thank the author for bringing this and thank you for letting us be a part of this history. Because as Assemblymember Wynn said, this is long overdue. Of course we should have Native American Day to celebrate our people, our first people. This is your country.
- Tina McKinnor
Legislator
And so before there was a King Day or a Cesar Chavez Day, there should have been a Native American Day. So I am so proud to be here to be a part of this history. And I'm recommending an aye vote.
- Tina McKinnor
Legislator
And thank you. I'm sorry. I'm sorry. And I'm also would like to be a co author of the Bill.
- James Ramos
Legislator
Well, thank you so much. And it really does bring a lot of recognition in the State of California to all California Indian tribes to be able to celebrate the fourth Friday of September as a paid holiday. Something that is long overdue.
- James Ramos
Legislator
And I want to thank the makeup of the Legislature today that has allowed this Bill to continue to move forward with that. I ask for your aye vote not just for me, but for all of our ancestors and all of California Indian people.
- Tina McKinnor
Legislator
And I can't wait to celebrate the first holiday. Madam Secretary, please call the roll.
- Tina McKinnor
Legislator
We have sufficient votes to put it on hold. Thank you. Next we'll have Assembly Member Carla A.B. 268 Kalra.
- Ash Kalra
Legislator
Good morning, Madam Chair Members. A.B. 268 as Diwali is an official state holiday in California, and I'm proud to author it a long with our colleague, Assembly Member Patel.
- Ash Kalra
Legislator
Diwali, a festival of great significance to Indian Americans and South Asian Americans and is celebrated annually by Hindus, Sikhs, Buddhists and Jains of all ethnic backgrounds throughout the United States and across the globe.
- Ash Kalra
Legislator
The exact date of Diwali is determined by the 15th day of the month of Karthik and Hindu lunar new year, lunar calendar of each year. It's kind of like our lunar new year, right? And it does happen typically towards the end of October or early November.
- Ash Kalra
Legislator
Even though California often leads in its diversity, we're not the first state to specifically recognize the value in its state laws. Last year, Pennsylvania became the first state to officially recognize the Valley as a state holiday. New York requires public schools in the City of New York to be closed on the Valley as a school Holiday.
- Ash Kalra
Legislator
Other states are also considering similar recognitions through state measures, including Massachusetts, Nevada, Illinois, and Connecticut. The analysis does a thorough job explaining the broad approach taken with other cultural, religious, and heritage days. However, Diwali is also broad, is also broad and multicultural, and California is home to the largest population of Indian Americans and South Asians.
- Ash Kalra
Legislator
I appreciate the suggestions made in the analysis, and we'll take them into consideration should this Bill pass today. Respectfully. As for an aye vote, thank you. This is my Chief of Staff who's been working diligently on this, Ryan Guillen.
- Tina McKinnor
Legislator
Can we. Are there any witnesses in support. Please come up. State your name, organization and position. Are there any witnesses registered in opposition? Seeing none. Is there any witnesses that would like to come up and state their name, organization and position Would like to bring it back to the. To the dais? Yes. Thank you.
- Stephanie Nguyen
Legislator
Thank you, Madam Chair. And I, again, I like the previous one. Thank you for bringing this forward for us to be able to be a part of this. In my district, I've gone to mini Diwali celebrations. I love it. I love how the families come together and they bring their children and the celebration.
- Stephanie Nguyen
Legislator
And while I celebrate Lunar New Year, one of the things I've always brought forward was that growing up, it was always known as Chinese New Year. And that's what I would continue to call until I got older and I realized I'm not Chinese. And for us, we call it that. And so Lunar New Year encompasses every.
- Stephanie Nguyen
Legislator
All of us. However, in this situation, I love the fact that we can say that Diwali is something that we also celebrate as well, too, and it's being recognized, and it also is an opportunity for our community to learn about the different cultures and the different types of celebrations that we do here in our community. So thank you so much for bringing this forward.
- Tina McKinnor
Legislator
Thank you. Is there any other Members? Any more statements? Well, I'd like to. I can't wait to say Happy Diwali. Did I say it correctly? I can't wait to say Happy Diwali. And so I'm so proud of you for bringing this Bill forward. And, of course, I look forward to celebrating the rich culture of our communities. Would you like to close?
- Ash Kalra
Legislator
Yeah. Thank you so much, Madam Chair. I look forward to continued celebrations of what makes our state great, which is this extraordinary diversity, as mentioned. And I think very similarly, when I was growing up and would go to the Valley celebrations, It was pretty much all Indians or all South Asians.
- Ash Kalra
Legislator
Now you're seeing so many others from the community. Just like with that celebrations, it's not just the Vietnamese community anymore. And that's a beautiful thing. We're starting to understand and celebrate with one another what makes this state so great. And with that, I respect the aspirin. I vote.
- Tina McKinnor
Legislator
I have a motion by Assembly Member Berner and a second by Assembly Member Nguyen. Please call the roll.
- Tina McKinnor
Legislator
We have sufficient votes to put on hold. Thank you. Thank you. Assembly Member Chavo, we're ready for you. AJR3. Good morning.
- Pilar Schiavo
Legislator
Hi. Thank you, Madam Chair and Members. I really appreciate this opportunity to present AJR3 a resolution to send a strong message to Congressional leadership, California's Congressional delegation and the White House that Social Security, Medicare and Medicaid are foundational to our communities and that any cuts to these programs will only create irreparable harm.
- Pilar Schiavo
Legislator
Social Security is our nation's most important source of retirement income, disability and life insurance. And for over 6 million Californians, including veterans and those who serve who those with severe work disabilities, the program provides monthly cash benefits and health insurance.
- Pilar Schiavo
Legislator
We must remember that the Social Security system is one where those now receiving benefits paid into the system their entire working life on the promise that when the time comes, they would receive the benefits they were entitled to. This is very literally money that everyone has paid into and should receive back.
- Pilar Schiavo
Legislator
Like Social Security, Medicare is also a critical lifeline to seniors and persons living with disabilities. The health care provided under Medicare makes sure that the population with the highest health care costs are provided care at a fraction of the administrative costs of private health care plans.
- Pilar Schiavo
Legislator
Current federal proposals could change how care is delivered under Medicare and result in an increased health care security and cost for those who rely on it, especially our seniors. And finally, this AJR calls for our representatives to protect Medicaid or Medi Cal in California.
- Pilar Schiavo
Legislator
For nearly 15 million Californians, including children and families, Medi Cal is their only source of health care, providing primary care services, dental and vision care and mental health care, substance use disorder services and long term care as well. Medi Cal is already caring for working people in our state, with 1 in 5 of all California workers enrolled.
- Pilar Schiavo
Legislator
With me to speak today to support AJR3 is Hene Kelly, Vice President of the California Alliance for Retired Americans and Sherry Williams from SEIU Local 2015.
- Hene Kelly
Person
Yes, ma'am. I am Henny Kelly. Proposed cuts to Social Security, Medicare and Medicaid will impact seniors as well as young people.
- Hene Kelly
Person
It is impacting me because I lost my husband on November 72024 and I have been told that it will be an additional 180 to 240 days to get an appointment with Social Security to receive his death benefits and his Social Security. I am not alone in this.
- Hene Kelly
Person
I have talked to people who have lost their houses and lost their everything because it didn't work. Cara does outreach, regardless of politics, and we let people of all ages know about laws that may impact them and how they can advocate. Retirees are scared. They're already struggling to afford their health care housing on a fixed income.
- Hene Kelly
Person
If you get to be old like me, you'll likely have some disabilities. But Social Security is for disabled people of all ages. About 25% of Californians who receive Social Security are under 65. And Medi Cal covers more than half of all California kids. If we cut Medicare or Medicaid Medi Cal services, people will die.
- Hene Kelly
Person
There will be more seniors and people with disabilities on our streets, young children on the streets. Emergency rooms will be swamped, making care more expensive for everyone. That's why I ask you to vote aye today on ajr. It is about decency and freedom.
- Hene Kelly
Person
And the time has come for us to pass it on to the next generation and the generation after them. For my grandchildren, your grandchildren, their grandchildren, this is the right thing to do.
- Sherry Williams
Person
Good morning, Committee Members. Thank you for holding this important hearing and considering AJR3, which I am here to support. My name is Sherry Williams. I've been a care provider for over 30 years.
- Sherry Williams
Person
And in the 10 years I have worked for IHSS, I am here to share with you absolutely critical role that Medi Cal play plays in the lives of millions of Californians and to speak out against the proposal in US Congress to cut 801.0 million billion one point from Medicare.
- Sherry Williams
Person
I have cared for approximately 15 people as an NIH care provider. Each one of them is valuable and an important part of their community. As a caregiver, I put myself in their shoes and ask them how I want to be treated, and that is the care I provide for them.
- Sherry Williams
Person
I'm going to share a story of two people, both veterans, whom I cared for. Peggy, in her late 50s, has developed multiple serious health conditions that kept her homebound. She had severe respiratory issues Heart disease and extreme limited mobility. She became a prisoner in her own home. Without care, she soon would have had been institutionalized.
- Sherry Williams
Person
Instead, IHS has allowed her to stay in her home and live in a life of great dignity. It has been her lifeline. Taking care away from her would be devastating. Not to mention the medical care that she relies on provided by Medi Cal Oxygen Medications, respiratory therapy and frequent Doctor visits. She served the country.
- Sherry Williams
Person
She served this country. She contributed her to her community. And she is now in need of care. Something that could happen to any one of us. She doesn't deserve that. No one deserves that. Now let me tell you about Mack, another veteran. Someone who served our country and military and our state as a counselor in state prisons.
- Sherry Williams
Person
He has now has dementia and became. I began caring for him when he is 90. Everywhere we went, Costco Church, everyone knew him in Modesto. He was a Member of this community. He graduated from the State of the University of Sacramento care. He would have been at grave risk of becoming lost or even having an accident.
- Sherry Williams
Person
Common events for people with dementia without ihss. One of his children wanted how to quit their job. Who serves as an attorney in San Francisco. He had twin boys that both are criminal attorneys. So cutting this Bill $880 billion in Medicare and reducing the access to taking care away from Peggy and Matt.
- Sherry Williams
Person
This is a lie. I'm talking point the political politicians are hiding behind. I urge you to support AJR3.
- Tina McKinnor

Are there any witnesses that would like to give their name in opposition? Seeing none. I shall bring it back to the dais. Are there any Members with any questions or comments? Yes, Assembly Member Nguyen.
- Stephanie Nguyen
Legislator
Thank you, Madam Chair. I just want to thank you to the Assembly Member for bringing this first and thank you for sharing your story. I'm sorry for your loss, but the one thing, I mean, I loved everything you said, but I think the one thing resonates with all of us is that we have to do this for the next generations to come. It is for your grandchildren and our grandchildren and their grandchildren.
- Stephanie Nguyen
Legislator
And so this is a set in the right path and I'm more than happy to move this Bill and support this.
- Tina McKinnor
Legislator
Are there any. Would you like to make any comments? Thank you so much to the author for bringing this Bill. This is so important. This is not the time for us to cut Medicaid. Medi Cal. Right. We have been putting into these funds and we deserve for our most vulnerable to be taken care of.
- Tina McKinnor
Legislator
It's just really, really not the time. With everything else failing around us, we want people to be able to go to the Doctor. And so I am giving an ireco. Would you like to close?
- Pilar Schiavo
Legislator
Thank you, Madam Chair. And thank you, Members. You know, we. I also sit on a budget Subcommitee and we're seeing the kind of devastation that these cuts are not only going to make to the folks who are receiving these benefits and these services, but also to our whole state budget that will have ripple effects far beyond that.
- Pilar Schiavo
Legislator
These are critical programs, as you know, as we've talked about, that people have paid into. It's literally stealing money out of people's pockets to cut these programs and cut the benefits that they are owed.
- Pilar Schiavo
Legislator
And we think it's really important that we send a strong message here in California that we need to make sure we keep our promise that these benefits are here. As someone who, you know, my parents are on Medicare.
- Pilar Schiavo
Legislator
My dad could hear us tell him we loved him before he died because of the hearing aids he got from Medicare. I know personally how important these programs are and we cannot let these fail. Seniors were, 50% of them were below the poverty, living in poverty before we created Social Security, and we cannot go back to that.
- Tina McKinnor
Legislator
Thank you. And I'm so sorry for your loss as well. We have a We moved the Bill by Assembly Member Nguyen. Seconded by Assemblymember Berner. Madam Secretary, please call the roll.
- Committee Secretary
Person
The motion is be adopted. McKenna. Aye. McKenna I Lackey. Lackey I Alanise. Alanis I Burner. Berner I Elawari. Garcia. Aye.
- Tina McKinnor
Legislator
Thank you. Next we'll have Assembly Member Quirk-Silva. AB 1067 Good morning.
- Sharon Quirk-Silva
Legislator
Good morning, Madam Chair and Members of the Committee. I'd like to start by thanking the Committee consultants for their work and would like to accept the Committee's amendments. Before I begin my remarks, I do want to share how this Bill came about.
- Sharon Quirk-Silva
Legislator
As many of us in the legislative body know, we have Select Committees and we have hearings, sometimes joint hearings, and this came out of a special hearing last year with the CSUF and UCS regarding some of the issues that have been highlighted in potential issues with employees that sometimes reporting is not moved forward or investigated and then you see a resignation.
- Sharon Quirk-Silva
Legislator
So with that I will make my remarks. I'm proud to present AB 1067, which upholds integrity within our public service system and strengthens accountability by closing a loophole that has allowed some public employees to evade consequences for serious misconduct. AB 1067 requires public employers to complete misconduct investigations even if the employee under investigation retires during the process.
- Sharon Quirk-Silva
Legislator
Well documented abuses have shown that some individuals use retirement as a shield to avoid accountability. And again, this too often has happened in some of our higher education systems. And many of these cases, investigations are quietly dropped and wrongdoing is never officially recorded.
- Sharon Quirk-Silva
Legislator
This Bill reflects the simple principle that if someone misuses their position of public trust, they should be held accountable, retired or not. Under current law, once an employee retires, there is no obligation for the employer to continue the investigation. This creates a troubling gap in oversight, allowing individuals to walk away before the facts are fully known.
- Sharon Quirk-Silva
Legislator
Even worse, without a completed investigation, there is often no documentation of misconduct to refer to law enforcement, regulatory bodies or oversight entities. AB 1067 ensures that misconduct investigations continue their natural conclusion even if the employee is no longer on the payroll. This is not about in punishing retirees or in creating unnecessary burdens for agencies.
- Sharon Quirk-Silva
Legislator
It is about ensuring justice for those who have been victimized and protecting the integrity of our public institutions. By requiring that investigations move forward, we ensure that appropriate findings can be referred to law enforcement or used to inform decisions related to pensions, public safety and transparency. AB 1067 is a common sense reform for our state and local government systems.
- Tina McKinnor
Legislator
Thank you. Are there any witnesses in support? Please come forward. Any registered witnesses in opposition? Oh, I'm sorry. You could come forward. Yes. Give your name.
- Tina McKinnor
Legislator
Thank you. Any witnesses in opposition, please come forward. Seeing none, I would like to bring it back to the dais. Any comments from Members Assemblymember Alanis?
- Juan Alanis
Legislator
I have some questions about the Bill in regards to retirement. Are you now are you talking about those that retire after the conviction is made or prior to.
- Juan Alanis
Legislator
And then the investigation ends now is this and this is taking away their Retirement or
- Sharon Quirk-Silva
Legislator
There would, the retirement would only be impacted if there is a conviction.
- Juan Alanis
Legislator
Okay. So if say I was under investigation, I decided to retire prior to the investigation, the investigation continues, which it should, as your Bill also states as well. If found guilty, then their retirement is in jeopardy.
- Juan Alanis
Legislator
And so what do we do about the we just passed a Bill earlier, just prior to you, about Medicaid, Medicare for people who are dependent on that. So what do we do about the spouses in the family who are also dependent on that retirement for that? Do they get their half?
- Juan Alanis
Legislator
I would probably look into that too, because we have some spouses who are dependent on that retirement that are now getting taken for a choice that they did not make a decision on. I know we like to talk about supporting victims and I think that would be victimizing them.
- Juan Alanis
Legislator
I don't know if that was just an oversight, but that would be something I would think about. But I know with almost 30 years in public safety and seeing that, I too also did not like that they did not continue the investigation. So I do like that part. But I just wanted to bring that up too. And I definitely will be supporting this.
- Sharon Quirk-Silva
Legislator
No, I appreciate that. That is definitely something that we will dive deeper. .
- Stephanie Nguyen
Legislator
Assembly Member clarifying question only because Assemblymember Alanis asked. But this would only impact from the time that they are convicted.
- Stephanie Nguyen
Legislator
So if you worked for 30 years and the last five years is when you were convicted of the crime, the retirement would only you would still get the retirement, but it would just stop at where those last five years are or however many years it is. Right. So it's not completely gone. It's just up until the time that you
- Sharon Quirk-Silva
Legislator
For the retirement that you have occurred during that period of work.
- Sharon Quirk-Silva
Legislator
Yes. And again, knowing that many people are changing jobs more often, but there are still Some people who are in jobs for their entire career. So it could impact somebody for their entire career if found. If convicted.
- Tina McKinnor
Legislator
Is that. I don't think. If you read the analysis, it was the example that Assemblymember Nguyen gave. If you work 30 years in the last five years, these. I did something.
- Tina McKinnor
Legislator
Allegations. And I was investigated for those last five years. It'll only affect the five years of your retirement. You'll get the 25. But that five years could be taken away from you.
- Sharon Quirk-Silva
Legislator
And again It does sound punishing and it is punishing, but the goal is to make sure that these allegations are not only investigated. It does not mean that every investigation is going to turn out that every single allegation is confirmed and then there's a conviction. So this would only imply. If there is a conviction.
- Sharon Quirk-Silva
Legislator
Yes. And again, my hope on this Bill is that this is a very, very small amount of individuals that we are talking about. But the message is particularly to those that we've already seen in essence retired their way out of potential charges is we take this serious, that we do not condone using positions of power.
- Sharon Quirk-Silva
Legislator
And in many cases, these allegations have been at the highest levels and that we will pursue this. And with that, I respectfully ask for your aye vote.
- Tina McKinnor
Legislator
Thank you. Thank you. Madam Secretary, please call the roll. zero, I'm sorry. I need a motion and a second motion by Assembly Member Nguyen, second by Assembly Member Alanis. Madam Secretary, please call the roll.
- Tina McKinnor
Legislator
I'm handing the gavel over to the Vice Chair, Assembly Member Lackey. Thank you.
- Tina McKinnor
Legislator
Thank you. Mr. Chair, Members of the Committee, I'm presenting the Committee's Bill AB 1510. This is a cleanup Bill that makes various technical and conforming changes to existing laws regarding certain State employee pay and benefits and employer employee relations at the Santa Clara Valley Transportation Authority.
- Tina McKinnor
Legislator
This Bill repeals an obsolete law regarding pay and benefits to state employees who were Members of the California National Guard or US Military Reserves relating to the Bosnia crisis.
- Tina McKinnor
Legislator
Amidst various existing laws that reference this obsolete law and extends from 365 to 760 days certain pay and benefits to state employees ordered to active duty on or after September 112001 as a result of the war on terrorism.
- Tina McKinnor
Legislator
In addition, this Bill adds necessary provisions to the existing Santa Clara Valley Transportation Authority's employer employee relationship law by authorizing a party aggrieved by a decision or order of per to be filed for a writ of extraordinary relief from the decision or order in a court of competent jurisdiction.
- Tina McKinnor
Legislator
This addition is substantially similar to the provisions that currently exist in and apply to other statewide collective bargaining status. I respectfully ask for your aye vote.
- Tom Lackey
Legislator
All right. Thank you. You have any other witnesses in support Come forward, please go.
- Bryant Miramontes
Person
Good morning. Bryant Miramontes with American Federation of State County Municipal Employees and support. Just appreciate the Committee and Committee staff for their work on this Bill. Thank you.
- Tom Lackey
Legislator
Okay, do we have any witnesses in opposition who would like to come forward saying. None. We'll come back to the dais. Any remarks need to be made, Wish to be made. Okay, we need a motion. Okay, we have a motion and a second. Would you like to close Ma'am,?
- Tina McKinnor
Legislator
We're going to take a quick five minute recess. We'll be back.
- Juan Alanis
Legislator
Okay. Well. For Mr. Assembly Member, Josh Hoover. Good morning, Mr. Mrs. Chair and Madam Chair and Members. He appreciates the opportunity to present AB 1233 and would like to thank the Committee staff for working closely with his office. AB 1233 would establish a statewide database of classified positions, employment.
- Tina McKinnor
Legislator
I'm sorry. Assembler. Hoover, you could come in and present your Bill.
- Josh Hoover
Legislator
All right, so I think I heard where I left off, but AB 1233 would establish a statewide database of classified positions, employment history, including where they worked when and what positions they held, as well as records of substantiated investigations for egregious misconduct. I'm going to turn it over to my colleagues here to give their testimony.
- Tina McKinnor
Legislator
Yes. Catch your breath and you'll have two minutes each. Thank you. Thank you.
- Don Ogden
Person
Good morning, Madam Chair and Members. My name is Don Ogden. I'm the Associate Superintendent of Human Resources for the Folsom Cordova Unified School District. And also I'm a Member of the ACSA. Association of California School Administrators Human Resource Council. ACSA. Thanks, Assemblyman Hoover, for carrying AB 1233.
- Don Ogden
Person
This is a proposal that the Members of our HR Council have discussed for nearly six years. Because the noted flaw in hiring system for classified employees positions is not in place to keep bad actors out of school settings and keep students safe.
- Don Ogden
Person
School employers, despite the best efforts to conduct thorough background checks by conducting live scan, DOJ and FBI fingerprint checks and also calling known former employees lack information if the applicant does not disclose their full employment history or prior investigations for egregious misconduct.
- Don Ogden
Person
Our classified employees are essential to so many services and so many programs and they make important contributions to our students growth and well being. Unfortunately, some bad actors are able to stay in the school setting by changing employers. Upon termination or even when there's an investigation pending, they simply leave the school employer off their application.
- Don Ogden
Person
And because there's no record system, there's no way for a school to have a complete employment history for certificated employees. We have a system. This is a process for reporting employees. There's a process with a database for reference.
- Don Ogden
Person
As a matter of fact, the new AB25 34 has provided requirements that all former employees are contacted and all former employees are provided by every applicant. A statewide database with egregious misconduct information could also help expedite the background checks of the right applicants.
- Don Ogden
Person
Because we have more of a clear picture, AB 1233 will offer a critical tool to protect students and ensure their safety and well being is prioritized. I've yet to meet someone who isn't shocked that we don't have any system in place in the State of California for this purpose.
- Don Ogden
Person
Thank you again Assemblyman Hoover and we respectfully request your support of this Bill.
- Jeff Baca
Person
Thank you. Madam Chair Members. Jeff Baca representing the Riverside County Superintendent of Schools. We are a co sponsor of the Bill with axa. As my colleague representing NAXA indicated, we've been working on this for close to six years now. We've gone through numerous iterations of how such a database would be structured.
- Jeff Baca
Person
And we think that what's reflected in the Bill that's before you this morning strikes a balance between achieving our goal, which is to provide LEAs with an important tool to enhance the safety of students while also providing a fair process for employees.
- Jeff Baca
Person
Ultimately, we see this issue as being one of shared responsibility to ensure that our students are safe and that incidents of egregious misconduct involving students stop once and for all. We know it is a very small minority of school employees who are responsible for these incidents.
- Jeff Baca
Person
But the database that would be created by AB 1233 will close the gap that currently exists in our ability to. To determine where those instances are taking place and will also go a long way towards reducing that number to zero. With that, I thank Assemblymember Hoover and respectfully request your Committee support for the Bill. Thank you.
- Tina McKinnor
Legislator
Thank you. Are there any witnesses and support? Please come forward. Give your name, organization, and your position.
- Dorothy Johnson
Person
Thank you. Dorothy Johnson. On behalf of the Association of California School Administrators, but also offering support for my colleague who couldn't be here from the California Association of Suburban School Districts. Thank you.
- Michelle Gill
Person
Good morning, Madam Chair and Committee Members Michelle Gill. On behalf of California Association of School Business Officials. In support.
- Tina McKinnor
Legislator
Thank you. Seeing no other witnesses in support. Are there any witnesses that would like to testify in opposition? Please come forward.
- Sandra Burton
Person
Thank you. Madam Chair. Sandra Burton. We are just expressing concerns. We want to make sure that they're noted and really do appreciate the sponsors engaging with us early so that we feel pretty confident we can get our concerns addressed. But classified employees do not receive the. Same unbiased investigation and ultimate decision on their disciplinary allegations.
- Sandra Burton
Person
So we do want to make sure. That nobody is falsely accused and then. Have their reputation and careers tarnished forever. Thank you.
- Mitch Steiger
Person
Thank you, Madam Chair. Mitch Steiger with cft. We also have had great conversations with. The sponsor and author's office expressed similar concerns to SEIU and also just flagged. We'd like to have a longer conversation about what types of misconduct would qualify. It seems like it's a pretty broad net. We'd like to figure out ways to maybe narrow it down to the types of crimes that are really at issue here. Thank you.
- Chris Myers
Person
Thank you. Good morning, Madam Chair. Chris Myers with the California School Employees Association. Similar. We have concerns over kind of the broad language of the Bill and also the lack of due process rights. Really appreciate the author and the sponsors working with us on, you know, adjusting that language. Thank you.
- Tina McKinnor
Legislator
Thank you. Are there any other witnesses in opposition? Seeing none. I'll bring it back to the dais. Are there any comments from the Members? Well, I used to be a classified employee, and I would say I have the same concerns as the others.
- Tina McKinnor
Legislator
But of course, I'm recommending that I vote because I am sure you guys will work together. This is what I like to hear, that people come together. All the smart people come together, work on the Bill, and come out with everybody being happy. And so with that, would you like to close?
- Josh Hoover
Legislator
Absolutely. And I will just close by kind of stating our commitment to that. Right. We want to make sure that we Come to a place where everyone's in agreement here. Under the current Bill, the misconduct that. Is defined in education include. I mean, these are things that include the most serious sex and drug offenses involving a child.
- Josh Hoover
Legislator
It does not include acts involving other adults. So if there is some narrowing that needs to take place, we're happy to look at that and work with the opposition, but would greatly appreciate your support in moving this Bill forward to the Next Committee. Thank you.
- Tina McKinnor
Legislator
Thank you. Madam Secretary. zero, I'm sorry. There was a motion by Assembly Member Berner, seconded by Assemblymember Lackey. Madam Secretary, please call the Roll.
- Committee Secretary
Person
The motion is do pass, and we refer to the Committee on education. McKenna. Aye. McKenna I. Lackey. Aye. Lackey I. El. Anise. Aye. Aye. Lanise I. Burner. Aye. Berner I. Elari. Aye. Elawari I. Garcia. Aye. Garcia I. Win. Win. I. We have seven votes. That Bill is out.
- Tina McKinnor
Legislator
Okay, I'm going to turn the gavel over to the Vice Chair. Assembly Member Tom Lackey.
- Tina McKinnor
Legislator
Thank you, Mr. Chair. Members. AB 1383 makes limited revisions to the California Public Employees Pension Reform act, or pepra, to address recruitment and retention challenges among the state's first responders.
- Tina McKinnor
Legislator
15 years ago, and in order to stabilize the state's retirement system, the Legislature made significant modification to public employee retirement benefits, including the retirement formulas, the age of the retirement, and requiring public employees to contribute more to their own retirement benefits.
- Tina McKinnor
Legislator
While many of these changes to PEPRA are still necessary for the long term health of the retirement Fund, retirement formula reductions are a contribution factor to vacancies throughout the public sector in the state, especially with our first responders. AB 1383 does not grant retroactive retirement benefit increases or pension holidays.
- Tina McKinnor
Legislator
It does not change other necessary and appropriate pepra guardrails. AB 1383 only applies prospectively. Recognizing the ongoing challenges and dedication of our firefighters, police and the unique challenges and risks associated with the career as a first responder.
- Tina McKinnor
Legislator
AB 1383 represents our need to recruit and retain the next generation of the first responders needed to protect the lives and property of residents across California. And today I have with me Brian Rice, President of the California Professional Firefighters, and Lamont Nguyen, President of the Long Beach Firefighters Local 372.
- Brian Rice
Person
Thank you. Good morning, Mr. Chairman. A little bit awkward for me, our author and chair, but I'm Brian Rice. I am the President of the California Professional Firefighters. I represent over 35,000 firefighters and emergency medical personnel throughout California. I served nearly 30 years as a firefighter right here in Sacramento.
- Brian Rice
Person
And serving my community as a firefighter was absolutely the best career. It's the best career I could have asked for. I'm proud and I'm grateful for the work that I was able to accomplish on behalf of our community over three decades. And I wouldn't change it for anything.
- Brian Rice
Person
But the fact remains that with each passing year, we learn more and more about how dangerous this profession really is. Where heart disease used to be the most common affliction for firefighters, it's now unquestionably cancer. Each year, cancer takes more of my Members, colleagues and friends. And the risk only keeps growing as we get older.
- Brian Rice
Person
Pursuing a retirement age at 57. Every day spent on this job means more exposures to deadly potent carcinogens like diesel fuel, pfas, asbestos, benzene, hydrogen fluoride, off gases from electronics. As we're learning, lithium ion batteries, plastics in all forms.
- Brian Rice
Person
There are so many substances in mixed with fire that are so toxic to the body that it can't even name them all. Each day has a cost, and it's one that we pay for with our lives a little bit at a time.
- Brian Rice
Person
The jobs physically and mentally demanding in the extreme and asking us to work until we're 57 years old is pushing us not just to our limit, but beyond it. And I don't want to bury. I don't want to bury another friend before their time in the name of hypothetical cost savings. And that's what we're talking about here.
- Brian Rice
Person
Were trading firefighters and police officers lives for money, period. By lowering the retirement age of firefighters and other public safety officials to 55, this Bill takes a reasonable measured steps to balance both the security of the retirement funds and protect the health of the men and women who have stepped up to protect us all.
- Brian Rice
Person
And for their sake in the future of our profession, I strongly urge support on AB 1383 and ask for your aye vote. Thank you for this time.
- Lamont Nguyen
Person
Good morning, Mr. Chair, honorable Members of this Committee, my name is Lamont Nguyen. I am President of the Long Beach Firefighters Local 372. I've been serving in a capacity as a Firefighter paramedic since 2018 for the Great City of Long Beach.
- Lamont Nguyen
Person
I'm pleased to be here today in support of AB 1383, and I would like to thank the authority and the Committee for their Hard work and consideration on this incredibly important proposal.
- Lamont Nguyen
Person
I'm pleased to be here today and again, I don't want to be repetitive of the impactful comments of what President Rice has already said, but I would like to note as a firefighter who is subject to a formula with the normal retirement age at 57, I'm deeply concerned about how my body is going to handle the stress and the impact and exposures at 5556 and thus 57.
- Lamont Nguyen
Person
With that said, I'd like to focus my comments on the importance of the provisions of this proposal that restore collective bargaining rights for employees when it comes to their retirement benefits. As this Committee knows, collective bargaining is critical to allow employees and employers to come together and coalesce on issues impacting wages, hours and working conditions.
- Lamont Nguyen
Person
Current law limits our ability to bargain over critical issues like the employer and employee share of the normal costs and prospective changes in the retirement formula. As the President of a local, permission to bargain over these items does not guarantee that they will occur.
- Lamont Nguyen
Person
But this will allow more me to better represent all of my Members, particularly the more than half of whom were hired after 2013 who are subject to these bargaining limitations. AB 1383 restores collective bargaining rights in a manner that doesn't make any affirmative decisions, but does give us all room to discuss at the table. For all these reasons, I respectfully ask for your aye vote today. Thank you.
- Tom Lackey
Legislator
Okay. Do we have any other witnesses? I'm guessing we might. Please express your name, your position and who you represent,

Legislator
Well, I think we got the impression that firefighters support the spell. Okay. Do we have any opposition? You may step forward and proceed when you're ready.
- Lisa Murphy
Person
Thank you. Good morning. I'm Lisa Murphy, Assistant City Manager for the City of Salinas. And I'm here on behalf of the League of California Cities. I have 25 years in public service. My partner, he has over 25 years in law enforcement. And my son is currently in the fire academy right now.
- Lisa Murphy
Person
And my youngest son is also aspiring to be a firefighter as well. Let me tell you, I bleed red and blue and I'm here to protect my son's retirement as well as all the firefighters who are here earlier testifying.
- Lisa Murphy
Person
AB1383, though, however, is currently drafted, threatens to reverse over 15 years of critical pension reform designed to protect the long term viability of PERS's retirement system.
- Lisa Murphy
Person
The PEPRA enacted in 2013 was the result of careful planning aimed at stabilizing a system that was on the brink of unsustainability, largely due to the generous retirement enhancements granted during the 2000s. Returning to those benefit structures would severely compromise the future of health of PERS.
- Lisa Murphy
Person
Today, cities and counties are already allocating millions annually to cover the existing pension obligation. For the City of Salinas, we have over $11.4 million that we pay annually into PERS. That's over 8% of our budget. This Bill in its current form will not resolve staffing shortages as you saw present today.
- Lisa Murphy
Person
Instead, it will drive up pension costs which will likely result in fewer available dollars for salaries and direct services. In effect, this could actually hamper recruitment efforts rather than support them. We all share the goal of strengthening our workforce by improving recruitment strategies and offering competitive salaries.
- Lisa Murphy
Person
By working collaboratively with our unions, our local schools and colleges, we can continue to attract and retain talented public safety professionals. I commend the author's intent to enhance public sector hiring. However, salary remains the most influential factor when individuals choose an employer. But public service is a calling as well. It comes from the heart.
- Lisa Murphy
Person
AB1383, if passed, will strain cities ability to offer competitive wages and healthcare benefits. More alarmingly, it could undermine the very retirement our system our employees are counting on to be there in their future. Given the current economic uncertainty, this proposal is especially risky.
- Lisa Murphy
Person
PERS recently suffered a loss of $15 billion due to the market volatility costs that will inevitably be passed on to cities already contending with shrinking revenues and increasing expenses to maintain essential services. Now is not the time to increase the financial burden on local governments.
- Lisa Murphy
Person
The reforms brought by PREPA have been instrumental enabling cities to continue providing vital services including police and fire, and allowed us to be competitive salaries. And doing these reforms would compromise not only pension stability, but the overall ability of municipalities to serve their communities effectively. Let's work together.
- Lisa Murphy
Person
There are strategies that we could implement that will protect our firefighters' retirement plans that they absolutely so deserve. And I want it to be there for them. But we need to protect it in the right way and I think with a few tweaks we could probably get there. Thank you and I urge you to oppose this Bill.
- Bob Nelson
Person
Good morning Vice Chair and Committee Members. I'm Bob Nelson, second Vice Chair of Rural County Representatives of California and a Santa Barbara County Supervisor. And counties like mine are fully committed to recruiting and retaining strong public safety workforce. A strong public safety workforce. We're actively exploring solutions to address workforce shortages in law enforcement, EMS, fire and healthcare.
- Bob Nelson
Person
But AB1383 moves in the wrong direction. This Bill rolls back hard-won reforms the Public Employee Pension Reform Act of 23rd, of 2013, and reinstates benefit formulas we already know are unsustainable. In the 1990s and the early 2000s, similar pension packages nearly bankrupt at this state and many of our local municipalities.
- Bob Nelson
Person
We don't need to test them again. We've lived with the consequences. Since 2010, Santa Barbara county has paid over $100 million annually in additional payments to stabilize this retirement system. Sacrifices that brought our funded status from 62% up to 87%. But those payments came at real costs.
- Bob Nelson
Person
Reductions to pay public safety staffing and fewer resources to address mental health, homelessness and criminal justice reform. It's hard to recruit when we can't afford competitive salaries. But worse than low pay is an unsafe working environment caused by constant overtime burnout and insufficient staffing. The result of budgets stretched in by rising pension costs.
- Bob Nelson
Person
This Bill would send us further in that direction by allowing employers to adopt optional benefit tiers like 3% of 55 negotiating below the 50-50 cost share. And AB1383 creates a new arms race between municipalities. The ones most hurt will be those socially economically disadvantaged communities, those least able to afford this race to the bottom.
- Bob Nelson
Person
We with all due respect to the author and the Chairwoman, we urge you to reject AB1383 as drafted. Instead, to work with us on sustainable collaboration strategies that truly support public safety without undermining the fiscal health of our communities. Thank you.
- Tom Lackey
Legislator
Okay, if we have any other witnesses that would like to express their opposition, please come forward.
- Jean Hurst
Person
Thank you Mr. Chair, Members. Jean Hurst here today on behalf of the Urban Counties of California in respectful opposition.
- Aaron Avery
Person
Good morning, Mr. Chair and Members. Aaron Avery, California Special Districts Association, respectfully opposed. Thank you.
- Sarah Dukett
Person
Sarah Dukett, on behalf of the Rural County Representatives of California and the California State Association of Counties, regretfully opposed.
- Brian Mohan
Person
Brian Mohan, Moreno Valley. Strong respectful opposition due to the increased cost to every municipal employer. Thank you.
- Tom Lackey
Legislator
All right, seeing no other people that want to come forward to express their opposition, we'll bring it back to the table here.
- Tasha Boerner
Legislator
I want to thank the author for bringing this forward. I had the opportunity to just have a glimpse into what our fire corps do. I'm 52. I'm super fit. I work out four times a week. I could probably leg press more people, more weight than most people in this room.
- Tasha Boerner
Legislator
And doing what they do at 52 is really hard. And we cannot say we financially can't afford the fire defense and the law enforcement defense that we deserve. The first role of government is to make sure that people don't die. And that's what our firefighters do every day.
- Tasha Boerner
Legislator
And to make this trade off that we can't afford to do this when it's the right thing to do is the wrong approach. So I would hope that the opposition would work with the authority. She's an amazing Legislator. Because we need to get this done, and we cannot expect people to physically work themselves into the grave.
- Tasha Boerner
Legislator
That is not the approach that we should have in California. With that, I move the Bill. I would like to be added as a co-author.
- Tom Lackey
Legislator
Okay, thank you. Do you have any other comments? Yes, please proceed.
- Stephanie Nguyen
Legislator
Thank you. Thank you, Mr. Chair. I want to thank the author for bringing this forward as well. And like my colleague over there, I went out there when the firefighters had the obstacle course right in front of the Capitol and I did all but I think one. And you know, I feel like I'm pretty physically fit.
- Stephanie Nguyen
Legislator
I'm not super fit, but I. But I, you know, climbed on that ladder and went all the way up there. I just about died right after. I feel like for weeks I was hurting as well.
- Stephanie Nguyen
Legislator
And I can't believe that we allow our firefighters to do this up until the age of 57, and that there needs to be something that protects them and their health and their livelihood and their family as well, too.
- Stephanie Nguyen
Legislator
And as President Rice mentioned about the particles that they're breathing in, inhaling every single day, I think in this line of work, we as legislators here that work in the office, we are not subject to that every single day. And they are. And we have to remember that these are not just firefighters.
- Stephanie Nguyen
Legislator
They are brothers, they are sisters, they are mothers, they are fathers, they are daughters, they are son. They too need to be protected in these lines of work. Just like what we do here when we protect our employees, our staff, we put things in place, guardrails in place.
- Stephanie Nguyen
Legislator
We need to do the same for those that keep our community safe every single day. So I'd like to also be a co-author if possible. And I will be supporting this today as well. Thank you.
- Juan Alanis
Legislator
Thank you. Ms. Murphy, thank you for your family service. And I just had a question about what few tweaks would you like to see?
- Lisa Murphy
Person
You know, there's an option. So I'm a miscellaneous employee, right, in purse, and our formula is 2% at 55, but I can retire at 50, so I'm eligible early. My formula, what I'll get will be a lot less.
- Lisa Murphy
Person
Yeah. Depending on my years of service, right. But for public safety they actually don't have that option at all. So let's say your current fire fighter, a classic number is its 3 at 50. They couldn't make the decision to say "You know, at 45, I think I'm going to go. I'm vested. I can go do something else."
- Lisa Murphy
Person
So there isn't that option for either law enforcement or public safety. So that could be something that should be thought of and could be included. So rather than 57, they could retire as long as they're vested similar to us in five years less, that could be an option. I think it's not just the age.
- Lisa Murphy
Person
The age piece is a really, that is a vitally important piece and I, I recognize that. But it, it's the other parts of the legislation is too that could use a little more consideration. The, the raising the cap on the pensionable salary is, is an issue.
- Lisa Murphy
Person
And we already do have the right to bargain with our unions over picking up the employer, picking up the employee portion. We, we have that right and I know we do do that.
- Lisa Murphy
Person
A lot of cities have been forced to go ahead and, and pick up more of the employees portion because of the competitiveness of that, of the nature. So that piece is a little bit, we already have that right. And finally, you know, the opportunity to contribute to defined contribution plan is also there as well.
- Juan Alanis
Legislator
Okay, great points. Not every retirement system in California has that same motto. I want to attest to that. I actually left earlier for mine. I was a classic employee, so was able to take the percentage hit but still made it worth it to get out and do what I'm doing today.
- Juan Alanis
Legislator
So I see where you guys are coming from. I, I have a son who's in law enforcement as well, who's also under PEPRA or who is under PEPRA.
- Juan Alanis
Legislator
And so I feel for him and all those that came up and those that fall under PEPRA who with this Bill will at least possibly get the chance to get two years of their lives back. I probably would have made it a lower age, but I think 55 is pretty fair, at least a good start.
- Juan Alanis
Legislator
So I see your points, but I'm definitely very supportive of this Bill and I am thankful that we are looking out for our first responders who do put their life on the lines every day, and that we are showing that we appreciate them by at least giving them some life back to them, with them, to enjoy retirement and maybe some time with their family as well.
- Tom Lackey
Legislator
Thank you. Do you have anybody else who would like to weigh in? Because I am going to make some remarks myself. I think that this is a very delicate issue. I understand affordability, but I also understand the unique nature of first responders.
- Tom Lackey
Legislator
Having had a career in law enforcement, I've seen the reality that one of the things you balance with these chosen careers is not just cumulative impacts of the job, but immediate threats. The immediate threats are very real and that makes this profession, these professions, very unique.
- Tom Lackey
Legislator
I will tell you that I've been at the scene of very tragic circumstances. And so the reality of this profession impacts me a little differently than some people. It's not dollars to me, it's bodies, its people, its relationships. August 31, 2009 I was at the scene of a very long term memory of mine.
- Tom Lackey
Legislator
It will never go away. Where they brought up the remains of two firefighters who lost their lives in a tragic firefighting event. Captain Steve Hall and Arnie Quinones, the firefighter. That reality kind of shifts my focus because those people will not collect any retirement and they did fund it. Certainly there's not enough to balance that out financially.
- Tom Lackey
Legislator
But the reality of what that means needs to be thought about, needs to be carefully thought through, that these immediate threats often get forgotten. And we think about the cumulative impacts and how strong is somebody, if they reach that age, some of these tragic circumstances.
- Tom Lackey
Legislator
I went to two funerals this month of law enforcement officers who lost their lives. They were in their 30s. That's a reality that doesn't become part of the discussion that needs to be thought through. And so, because I think your concerns are not misplaced, they are real and there's something to be thought about.
- Tom Lackey
Legislator
But the reason why I support this is because it's not like, I mean, we saw the big long line of people here today that was not meaningless. But what's more meaningful to me is the realities of this unique pathway. You know, service does come from the heart, as was stated earlier.
- Tom Lackey
Legislator
But with these unique threats, they stop that heart. And that needs to be thought about. So I am in support of this Bill and your free to close.
- Tina McKinnor
Legislator
Thank you, Mr. Chair. I did this Bill because I really do support the lives of these first responders. I understand budget, you know, what you're going through as administrators and looking out for county departments, but these are lives. These are people who show up for us.
- Tina McKinnor
Legislator
In Los Angeles, we just had one of the biggest fires we've ever had in the history of Southern California. And to see the lines of all these guys showing up and men and women, this is how they showed up for us when we had this disaster, like, never ending.
- Tina McKinnor
Legislator
Just people after firefighters, after firefighters, after police officers, after first responders. They saved our lives as well. And they put their lives on the line, and so they deserve to have this. So we have to figure it out. But I would love to talk to you. My door is never closed.
- Tina McKinnor
Legislator
I'm always willing to speak with people because I think if we get in a room and talk to each other, we can come to some kind of agreement that makes us all happy.
- Tina McKinnor
Legislator
But I also, you know, I did this because I really, truly respect these first responders and how they put their lives on the line for us. And with that, I'll ask for your aye vote. Thank you.
- Tom Lackey
Legislator
Thank you very much. Madam Secretary. Go ahead and please call for the question.
