Existing law prescribes requirements for the disposal of surplus land by a local agency. Existing law defines surplus land for these purposes to mean land owned in fee simple by any local agency for which the local agencys governing body takes formal action in a regular public meeting declaring that the land is surplus and is not necessary for the agencys use. Existing law provides that an agency is not required to follow the requirements for the disposal of surplus land for exempt surplus land, except as provided. Existing law defines exempt surplus land to include certain types of land, including surplus land that the local agency is exchanging for another property necessary for the agencys use.

This bill would define exempt surplus land to include land that: (1) is being or will be developed for a health facility, as defined and specified; (2) is located at one of certain sites within the City of Sacramento; (3) is not identified in the sites inventory in the applicable housing element for lower income households; and (4) will be subject to a recorded deed restriction for a period of 55 years, as specified. The bill would provide that the owner of a health facility that fails to meet certain of these requirements is liable for a civil penalty, as specified.

This bill would make legislative findings and declarations as to the necessity of a special statute for the City of Sacramento.
