| 1. | The funds appropriated in this item are for the support of counties that request assistance for costs incurred between April 26, 2016, and July 15, 2016, inclusive, in conducting the June 7, 2016, primary election simultaneously with completing statewide initiative signature verifications in a timely manner. The Controller shall reimburse a county that requests assistance with costs incurred conducting the June 7, 2016, primary election and verifying statewide initiative signatures in an amount not to exceed that established by a formula created by the Secretary of State based on the total number of signatures submitted to the requesting county and the number of eligible voters in that county. This formula shall be provided to each county by May 1, 2016. | ||||||
| 2. | To be eligible for the reimbursement of costs provided for in this item, a county elections official shall do all of the following: | ||||||
| (a) | Comply with Sections 12223, 12224, 12286, 14102, 14103, 14104, 14105, 14105.1, 14300, and 14310 of the Elections Code with respect to the June 7, 2016, primary election. | ||||||
| (b) | Demonstrate that for all statewide initiative petitions filed in that county on or before May 20, 2016, (1) the county completed the determination pursuant to subdivision (b) of Section 9030 of the Elections Code and provided the total number of signatures for each petition to the Secretary of State no later than May 27, 2016; and (2) the county completed the determination pursuant to subdivision (d) of Section 9030 of the Elections Code and provided the results of the random sampling for each petition to the Secretary of State no later than 12:00 p.m. on June 30, 2016. | ||||||
| (c) | Prepare, sign, and certify as true and accurate a report that identifies costs related to the June 7, 2016, primary election and verifying statewide initiative verifications, and, on or before August 1, 2016, submit to the Controller the report, detailed invoices with supporting documentation, including timesheets and salary information, and any other information the Controller requires in order to verify (1) the countys costs incurred conducting the June 7, 2016, primary election and verifying statewide initiative signatures, in an amount not to exceed that established for the county in the Secretary of States formula; and (2) the countys compliance with the requirements of this item. | ||||||
| 3. | Upon receipt of a report pursuant to subdivision (c) of Provision 2 that is signed and certified as true and accurate by the county elections official, the Controller shall reimburse the county for the costs specified in this item related to conducting the June 7, 2016, primary election and verifying statewide initiative signatures. | ||||||
| 4. | Of the funds appropriated in this item, up to $115,000 shall be provided to the Secretary of State for state operations costs in support of county June 7, 2016, primary election and statewide initiative signature verification efforts. | ||||||

SUMMARY: Amends the 2015-16 Budget Act to provide the Secretary of State an additional $16.3 million for unexpected costs related to the 2016 elections. Specifically this bill:
- Appropriates $16,288,000 for local county voter registrar offices to request assistance for costs incurred between April 26, 2016 and June 7, 2016.
- Instructs the Controller to not exceed the reimbursement authorized by a formula created by the Secretary of State based upon the total number of signatures submitted to the requesting county.
- Requires counties to meet the following requirements to receive reimbursement:
- Comply with existing State law regarding election precinct size and formation for the June 7, 2016 election;
- Meet existing State law requirements for the demonstration for all statewide petition filed in the county before May 20, 2016; and,
- Prepare a cost report to the Controller with supporting documentation.
- Appropriates $115,000 of the total funding for the Secretary of the State operations costs associated with this effort.
The Senate amendments replace the language of the Assembly version.
FISCAL EFFECT: This budgetary augmentation results in a $16.3 million General Fund cost.
COMMENTS: This amendment to the 2015-16 Budget Act responds to an urgent request for resources is the result of a confluence of two events. First, the hotly-contested Presidential primary is expected to generate record turnout on June 7, 2016, straining the resources of county voter registrars. Simultaneously, these offices are processing the petitions of ballot initiatives for the November 2016 ballot, which is expected to have a large number of initiatives for consideration.

Existing law requires counties to fund most elections expenses and establishes a county elections official’s role in conducting elections, such as supervising voter registration, processing the verification of signatures on statewide initiative petitions to qualify for a ballot, establishing precinct boundaries, and equipping polling places on election day. The state funds some elections costs, primarily the printing of the state voter information guide (VIG), which provides information about ballot measures and candidate statements.
The SOS, counties, and county elections officials raise concerns with current elections funding and capacity related to the June 7, 2016, primary election. As county elections officials prepare for the June primary, they also verify signatures on initiative petitions and assess whether a measure qualifies for the November 2016 ballot. As of April 14, 2016, eight measures have qualified for the November ballot, and another 15 remain in circulation and may qualify for the November ballot. Given the anticipated higher voter turnout during a presidential primary election and workload associated with verifying signatures on petitions in a timely manner, the bill provides additional funds to counties, and establishes a mechanism to reimburse counties that meet specified requirements, to assist them in conducting the June 7 primary election and in signature verification.
