(a)Each applicant for a certificate based upon a national board diplomate certificate, each applicant for a certificate based on reciprocity, and each applicant for a certificate based upon written examination, shall pay a nonrefundable application and processing fee, as set forth in subdivision (b), at the time the application is filed.
(b)The application and processing fee shall be fixed by the board by May 1 of each year, to become effective on July 1 of that year. The fee shall be fixed at an amount necessary to recover the actual costs of the licensing program as projected for the fiscal year commencing on the date the fees become effective.
(c)Each applicant who qualifies for a certificate, as a condition precedent to its issuance, in addition to other fees required herein, shall pay an initial license fee, if any, in an amount fixed by the board consistent with this section. The initial license fee shall not exceed seven hundred ninety dollars ($790). The initial license fee shall be prorated on a monthly basis. An applicant enrolled in an approved postgraduate training program shall be required to pay only 50 percent of the initial license fee.
(d)The biennial renewal fee shall be fixed by the board consistent with this section and shall not exceed seven hundred ninety dollars ($790).

When calculating the amount of costs for services for which the board paid an hourly rate, the board shall use the average number of hours for which the board paid for those costs over these prior three fiscal years, multiplied by the hourly rate paid by the board for those costs as of July 1, 2005. Beginning January 1, 2009, the board shall instead use the average number of hours for which it paid for those costs over the three-year period of fiscal years 200506, 200607, and 200708, multiplied by the hourly rate paid by the board for those costs as of July 1, 2005. (i)Not later than January 1, 2012, the Office of State Audits and Evaluations within the Department of Finance shall commence a preliminary review of the boards financial status, including, but not limited to, its projections related to expenses, revenues, and reserves, and the impact of the loan from the Contingent Fund of the Medical Board of California to the General Fund made pursuant to the Budget Act of 2008. SUMMARY: Requires that the fees for an initial license or an original license issued by specified regulatory entities under the Department of Consumer Affairs (DCA) be prorated on a monthly basis. Specifically, this bill:
Requires that the fees be prorated for the following licensees:
Dentist;
Dental hygienist;
Osteopathic physician and surgeon;
Occupational therapist or occupational therapy assistant;
Registered veterinary technician;
Veterinarian;
Acupuncturist; and,
Architect.
Makes conforming changes.
The Senate amendments:
Remove hearing aid dispensers, physical therapists, and physical therapist assistants from this bill.
Delay the implementation date for the proration to July 1, 2017.
Add chaptering language for bills AB 179 (Bonilla), Chapter 510, Statutes of 2015 and SB 800 (Business, Professions and Economic Development Committee), Chapter 426, Statutes of 2015.
FISCAL EFFECT: According to the Senate Appropriations Committee, this bill will result in:
Minor administrative costs to revise regulations and update forms and procedures for collecting initial license fees by several boards and committees within the DCA.
One-time costs of about $140,000 for information technology upgrades to the computer system used to process license applications.
Ongoing revenue loss of about $120,000 per year in reduced licensing fees. The following boards and committees would experience reduced license fee revenues: Architects Board ($16,000), Dental Hygiene Committee ($19,000), Osteopathic Medical Board ($10,000), Physical Therapy Board ($29,000), and Veterinary Medical Board ($76,000).
COMMENTS:
Purpose. This bill is author sponsored. According to the author, "[This bill] will decrease financial burdens on newly-licensed professionals in our state. Current law in California states that initial licenses for certain professions… expire on the last day of a licensee's birth month on the second year of their second term.
"For example, a constituent in my district… was notified that her brand-new license expired in three weeks, due to her birth date, and that she had to pay a full $160 renewal fee. This occurred only a few months after she paid $575 for her state exam and application and $100 for her initial license.
"Various licensing agencies have tried to remedy this issue, but this piecemeal approach still means that licensees in some professions pay far more than is appropriate for the duration of their initial license. [This bill] would standardize initial licensing fees across state-licensed professions that follow a birth month renewal policy. [This bill] makes a common-sense change to a policy that can adversely affect young professionals who are just starting out in their careers."
Background. Many of the boards within the DCA have implemented a birth date renewal program to calculate license expiration dates. Under the program, a license expires on the licensee's birth date or on the last day of the licensee’s birth month on the second year of a two-year renewal term.
For many boards, licensees submit applications for licensure at the same time (e.g. because of the timing of exams). This causes boards to have a large number of applications for initial licenses during peak times. As a result, many boards now renew licenses based on birth date, rather than the date the license was issued, which helps prevent the boards from processing large numbers of applications or renewals at one time. Depending on the board, the initial license period can vary from a few months up to 24 months, depending on the applicant's birth month.
Existing License Fee Pro Rata Formulas. Currently, there are boards that use an initial license fee pro rata formula. The Board of Psychology (BOP) and the Veterinary Medical Board (VMB) are required by statute to establish a birth date renewal program that includes a pro rata formula for the payment of fees. The Acupuncture Board (CAB) voluntarily established a pro rata formula through regulation.
The CAB has used a formula for an initial license that pro rates fees on a monthly basis. According to the CAB, its pro rata formula has been in place for over a decade and continues to operate well.
This bill would require various programs - but not all - within the Department of Consumer Affairs to prorate license fees, based on how many months have elapsed between the initial issuance of a license and time of renewal.
Creating an equitable licensing fee is a policy I support. Such an endeavor, however, can be crafted more carefully and thoughtfully through regulation.
I am directing the Department of Consumer Affairs to work with each board, bureau, and commission to devise a sound approach to guarantee that each licensee pays a fair amount.

Dental hygienist;
Osteopathic physician and surgeon;
Occupational therapist or occupational therapy assistant;
Registered veterinary technician;
Veterinarian;
Acupuncturist; and,
Architect.
Makes conforming changes.
The Senate amendments:
Removed hearing aid dispensers, physical therapists, and physical therapist assistants from this bill.
Delayed the implementation date for the proration to July 1, 2017.
Added chaptering language for bills AB 179 (Bonilla) and SB 800 (Committee on Business, Professions and Economic Development) of the current legislative session.

Requires the DBC to establish procedures for the administration of the birth date renewal program, including, but not limited to, the establishment of a pro rata formula for the payment of fees by licentiates affected by the implementation of such program and the establishment of a system of staggered license expiration dates such that a relatively equal number of licenses expire annually. (BPC § 1715)
Prorates the initial license fee for a dentist. (Title 16 California Code of Regulations § 1021)
Requires the Dental Hygiene Committee of California (DHCC) to establish licensing fees for dental hygienists, prohibits the initial license fee from exceeding $250, and provides that a dental hygienist license, unless specifically excepted, expires at 12 midnight on the last day of the month of the legal birth date of the licensee during the second year of a two-year term, if not renewed. (BPC §§ 1935, 1944)
Requires the Osteopathic Medical Board of California (OMBC) to establish fees for a biennial license fee to not exceed $400, and requires the OMBC to set a biennial license fee in an amount less than the full amount for applicants who indicate in writing that he or she does not intend to practice during the renewal period. (BPC § 2455)
States that all osteopathic physicians’ and surgeons’ certificates expire at midnight on the last day of the birth month of the licensee during the second year of a two-year term if not renewed on or before that day. (BPC § 2456.1)
Requires the California Board of Occupational Therapy (BOT) to establish the initial license and renewal fee for an occupational therapist and limits the fee to $150 per year, and provides that any license is subject to renewal as prescribed by the BOT. (BPC §§ 2570.10, 2570.16)
Requires the California Veterinary Medical Board (VMB) to set an initial license fee for veterinarians not to exceed $500, and to set the initial fee for veterinary technicians not to exceed $350; if a license is issued less than one year before the date on which it will expire, the fee is half of the original amount. (BPC §§ 4842.5, 4905)
Requires the VMB to establish procedures for the administration of the birth date renewal program, including the establishment of a pro rata formula for the payments of fees, and provides that all licenses and registrations expire at
12 midnight on the last date of the birth month of the registrant during the second year of a two-year term, if not renewed. (BPC § 4900)
Provides that the initial license fee for an acupuncturist not exceed $325; provides that licenses shall expire on the last day of the birth month of the licensee during the second year of a two-year term, if not renewed, and requires the California Acupuncture Board (CAB) to establish and administer a birth date renewal program. (BPC §§ 4965, 4970)
Requires the CAB to fix the initial license fee for an architect that is equal to the renewal fee in effect at the time the license is issued, and provides that license shall expire at 12 midnight on the last day of the birth month of the license holder in each odd-numbered year following the issuance or renewal of the license. (BPC §§ 5600, 5604)
This bill prorates the initial license or registration fee on a monthly basis, beginning July 1, 2017, for a dentist, registered dental hygienist, registered dental hygienist in alternative practice, registered dental hygienist in extended functions, osteopathic physician and surgeon, occupational therapist, registered veterinary technician, veterinarian, acupuncturist, and architect.
Background
Birthdate renewal system. This bill is designed to rationalize the fees paid through the birthdate renewal system, a renewal cycle employed by many DCA boards.
The birth date renewal system issues licenses for a period of time ranging between 12 and 24 months depending on the licensee’s birth month. If, for example, a licensee has a February birth date and his or her license is issued in March 2014, the license will expire at midnight on February 28, 2016. If, however, a licensee has a March birthday and his or her license is issued in March 2014, the license will expire at midnight on March 31, 2015.
In these examples, the license in the first scenario will expire after nearly two years, but in the second scenario, the license will expire after 12 months and five days. Despite the varying expiration dates, both licensees pay the same initial license fee.
This
bill will require DCA boards to prorate the initial license fee on a
monthly basis beginning July 1, 2017, so that licensees do not pay
the full fee amount if they are not receiving a full two years of
licensure.
Concerns regarding the regulatory boards. While this bill makes practical sense in theory, it has not received the full support of the regulated community its provisions impact. Professional licensees have expressed support through their associations, the California Association for Health Services at Home (unclear which professions in this bill fall within its membership) and the California Veterinary Medical Association. However, no DCA boards have submitted support letters, and the DHCC has voted to oppose this bill.
It has been indicated by boards with a birthdate renewal system that changing to a prorated system would be problematic logistically and financially. DHCC indicates that they would have to reprogram their licensing system, BreEZe, at substantial cost, and it would lose revenue currently relied upon due to the birth date system.
FISCAL EFFECT: Appropriation: No Fiscal Com.: Yes Local: No
According to the Senate Appropriations Committee:
Minor administrative costs to revise regulations and update forms and procedures for collecting initial license fees by several boards and committees within DCA Affairs (various special funds).
One-time costs of about $140,000 for information technology upgrades to the computer system used to process license applications (various special funds).

ARGUMENTS IN SUPPORT: The California Veterinary Medical Association writes, “AB 483 allows for relief from compounding costs associated with licensing fees when an applicant finds that they will be required to pay a renewal fee soon after their initial licensing, due only to the unique timing of their birth date. This common sense measure is of particular benefit to the students graduating from our two veterinary colleges in California, who are already burdened with an average of $100,000 of veterinary school debt. By allowing these applicants to pro-rate their licensing fees, [this bill] gives those who are starting out in the profession a bit more time to get their financial footing.” The California Association for Health Services at Home and the Fresno Chamber of Commerce all agree this bill will bring fairness to the licensing fee system.
ARGUMENTS
IN OPPOSITION: The DHCC writes in opposition to this bill, noting
that it voted at its May 3, 2015 meeting to take an oppose position
on
AB 483, as amended on April 9, 2015. “The DHCC supports
the Author’s efforts to decrease financial burdens on
newly-licensed professionals in our state, however, AB 483 would
place a significant financial burden on one of the DHCC’s main
revenue sources and fund condition at this time.
“The DHCC is currently in Release 2 of the Department of Consumer Affairs’ BreEZe online system and the DHCC’s existing licensing process has already been programmed into BreEZe. Adding the ability to prorate the original licensing fee on a monthly basis would require additional programming expenses and expensive change orders to the system.
“In addition, the Committee would stand to lose revenue if this bill were to pass, due to the proration of the $100 original license fee. The DHCC would need to pursue a fee increase to the original licensing fee equivalent to the current renewal fee of $160 (a $60 increase) to replace the lost revenue from having to prorate the fee (the original license fee has a statutory maximum of $250). Due to the significant fiscal impact of this bill and the DHCC’s inability to absorb these costs at this time, the DHCC respectfully opposes AB 483.”

This bill does not meet the criteria for referral to the Suspense File.
Bill Summary:
AB 483 would require several licensing boards and committees within the Department of Consumer Affairs to prorate initial license fees on a monthly basis.
Fiscal Impact (as proposed to be amended):
Minor administrative costs to revise regulations and update forms and procedures for collecting initial license fees by several boards and committees within the Department of Consumer Affairs (various special funds).
One-time costs of about $140,000 for information technology upgrades to the computer system used to process license applications (various special funds).
Ongoing revenue loss of about $120,000 per year in reduced licensing fees (various special funds). The following boards and committees would experience reduced license fee revenues: Architects Board ($16,000), Dental Hygiene Committee ($19,000), Osteopathic Medical Board ($10,000), Physical Therapy Board ($29,000), Veterinary Medical Board ($76,000).
Background:
Under current law, various boards and committees within the Department of Consumer Affairs license certain professionals and enforce educational and profession standards for those professions. In general, applicants for licensure pay an initial license fee upon application and pay a fee upon renewal of a license. Professional licenses are typically valid for two years.
Historically, licensing boards and committees experienced a large number of applications for initial licensure based on academic schedules. For example, most applicants for an initial license would apply for licensure soon after undergraduate or graduate training programs are completed and/or accredited professional examinations have taken place. Thus, licensing boards and commissions must typically process most of their applications for initial licensure at the same time every year. To avoid the same influx of applications for license renewal, licensing boards and committee’s often require licensees to renew their license during the licensee’s birth month, rather than on the anniversary of the initial licensure. This is done to spread out the workload for license renewal across the calendar year. Over time, many boards have experienced a shift in workload as changes in academic requirements or applicant preferences mean that an influx of applications for initial licensure does not always take place at one time of year.
Proposed Law:
AB 483 would require several licensing boards and committees within the Department of Consumer Affairs to prorate initial license fees on a monthly basis.
Specifically, the bill would require the following boards and committees to prorate initial license fees:
The Dental Board of California;
The Dental Hygiene Committee of California;
The Osteopathic Medical Board of California;
The Occupational Therapy Board of California;
The Physical Therapy Board of California;
The California Veterinary Medicine Board;
The California Acupuncture Board;
The California Architecture Board.
Related Legislation:
AB 773 (Baker) would revise require the Medical Board and the Board of Psychology to issue initial licenses for a full two calendar years. That bill is on this committee’s Suspense File.
AB 179 (Bonilla) would extend the sunset of the Dental Board and raise the existing statutory caps on fees imposed by the Dental Board. That bill will be heard in this committee.
AB 1758 (Patterson, 2014) was substantially similar to this bill, but also included the Medical Board and Board of Psychology. That bill was held on this committee’s Suspense File.
Staff Comments:
Typically, licensing fees charged by Department of Consumer affairs boards and committees are either explicitly set in statute or statute provides for the maximum fee that a board or committee may charge. In cases where the license fee is set at or near the maximum statutory fee, a board or committee impacted by this bill may not be able to raise fees on all license applicants to offset the revenue reduction required by this bill. As noted above, for several boards and committees, the revenue reduction is expected to be minor and can likely be absorbed by the board or committee. Of the boards impacted by this bill, some (such as the Acupuncture Board and the Dental Board) already prorate initial licenses. Other boards (such as the Physical Therapy Board and the Veterinary Board) have set their initial license fees below the statutory cap and therefore have some capacity to raise fee levels to offset revenue losses under the bill.
Author’s amendments: Would remove the Physical Therapy Board from the bill.

Requires the California Board of Occupational Therapy (BOT) to establish the initial license and renewal fee for an occupational therapist and limits the fee to $150 per year, and provides that any license is subject to renewal as prescribed by the BOT. (BPC §§ 2570.10, 2570.16)
Provides that licenses for physical therapists expire at 12 midnight on the last date of the birth month of the licensee during the second year of a two-year term if not renewed, and prohibits the Physical Therapy Board of California (PTB) from establishing a license fee that exceeds $150. (BPC §§ 2644, 2688)
Requires the VMB to establish procedures for the administration of the birth date renewal program, including the establishment of a pro rata formula for the payments of fees, and provides that all licenses and registrations expire at 12 midnight on the last date of the birth month of the registrant during the second year of a two-year term, if not renewed.
This bill prorates the initial license or registration fee on a monthly basis for a dentist, registered dental hygienist, registered dental hygienist in alternative practice, registered dental hygienist in extended functions, osteopathic physician and surgeon, occupational therapist, physical therapist, registered veterinary technician, veterinarian, acupuncturist, and architect.
FISCAL EFFECT:
This bill has been keyed “fiscal” by the Legislative Counsel. According to the Assembly Appropriations Committee analysis dated April 29, 2015, this bill will have the following fiscal impacts:
Revenue loss to affected boards attributable to lower average initial licensure fees of at least several hundred thousand dollars annually (various special funds). This may increase pressure on boards to raise fees. However, in some cases, fees are already set at their statutory maximums.
Minor and absorbable costs to affected licensing boards associated with changing cashiering procedures, forms and materials (various special funds).
$140,000 in Information Technology expenditures due to licensing system modifications. (various special funds).
COMMENTS:
Purpose. This bill is sponsored by the Author. According to the Author’s office,
“AB 483 prorates the initial license fee for various professions (specifically, dentists, dental hygienists, osteopathic physicians and surgeons, occupational therapists, occupational therapist assistants, physical therapists, veterinary technicians, veterinarians, acupuncturists, and architects) on a monthly basis to ensure that licensees are not overcharged for their licenses, as is the case currently.
“By basing license expiration and renewal on a licensee’s birth month, California law requires certain licensees to renew their license based on their date of birth rather than when they were first issued the license.
“While this policy was put in place to expedite license issuance, it can have an adverse financial effect on licensees who may have to pay the complete license issuance fee and then pay a full renewal fee once their birth month occurs after they are first licensed, even if only a few months have elapsed in between issuance and renewal. Because of this renewal policy, some licenses may last almost a full 2-year licensing term, while others may only last for a couple of months, yet the licensees in each case would pay the same initial license fee.”
In these examples, the license in the first scenario will expire after nearly 2 years, but in the second scenario, the license will expire after 12 months and 5 days. Despite the varying expiration dates, both licensees pay the same initial license fee.
This bill will require DCA boards to prorate the initial license fee on a monthly basis so that licensees do not pay the full fee amount if they are not receiving a full two years of licensure.
Related Legislation This Year. AB 773 (Baker) of 2015 recasts the expiration dates for certain licenses, certificates, and registrations issued by the MBC and the Board of Psychology based on the date of issuance instead of a licensee’s birthdate. (Status: This bill is pending in the Senate Appropriations Committee.)
Prior Related Legislation. AB 1758 (Patterson) of 2014 would have required the initial license fee for the following licensing categories to be prorated on a monthly basis: dentists; dental hygienists; physicians and surgeons; hearing aid dispensers; occupational therapists; physical therapists; psychologists; veterinary technicians; veterinarians; acupuncturists; and architects. (Status: This bill was held in the Senate Appropriations Committee.)
SB 2014 (Machado) of 2002 would have directed the MBC to prorate its annual licensing fees in cases where the initial licensure period is less than two years, and deleted an obsolete oral examination fee authority. (Status: This bill was held in the Senate Appropriations Committee.)
Arguments in Support. The California Veterinary Medical Association writes,
“AB 483 allows for relief from compounding costs associated with licensing fees when an applicant finds that they will be required to pay a renewal fee soon after their initial licensing, due only to the unique timing of their birth date. This common sense measure is of particular benefit to the students graduating from our two veterinary colleges in California, who are already burdened with an average of $100,000 of veterinary school debt. By allowing these applicants to pro-rate their licensing fees, [this bill] gives those who are starting out in the profession a bit more time to get their financial footing.”
The California Association for Health Services at Home, the Fresno Chamber of Commerce, and the California Physical Therapy Association all agree this bill will bring fairness to the licensing fee system.
Arguments in Opposition. The Dental Hygiene Committee of California (DHCC) writes in opposition to this bill, noting that DHCC voted at its May 3, 2015 meeting to take an oppose position on AB 483, as amended on April 9, 2015…. The DHCC supports the Author’s efforts to decrease financial burdens on newly-licensed professionals in our state; however, AB 483 would place a significant financial burden on one of the DHCC’s main revenue sources and fund condition at this time.
Staff Comments and Policy Issues:
Concerns regarding the regulatory boards. While this bill makes practical sense in theory, it has not received the full support of the regulated community its provisions impact. Several licenses affected by this bill have expressed support through professional associations: The Physical Therapy Association, The California Association for Health Services at Home (unclear which professions in this bill fall within its membership), and the California Veterinary Medical Association.
Other approaches. The Medical Board of California (MBC) was previously included in this bill, but requested to be exempted because they are adopting a different initial license system pursuant to AB 773 (Baker) of 2015, which establishes a full two-year license based on the issue date rather than the applicant’s birth date. AB 773, described above, would affect physician and surgeon’s certificates, registrations for spectacle lens dispensers and contact lens dispensers, and certificates to practice midwifery. It is anticipated that adopting this renewal system would be easier to implement than a prorated system and would also result in a more rational payment of fees by licensees.

SUMMARY: Requires that the fees for an initial license, an initial temporary or permanent license, an original license, or a renewal for specified regulatory entities, be prorated on a monthly basis. Specifically, this bill:
Requires that the fees imposed for an initial license, an initial temporary or permanent license, an original license, or a renewal be prorated on a monthly basis for the following licenses:
Dentist;
Dental hygienist;
Osteopathic physician and surgeon;
Hearing aid dispenser;
Occupational therapist or occupational therapy assistant;
Physical therapist;
Registered veterinary technician;
Veterinarian;
Acupuncturist; and,
Architect.
Makes conforming changes.
FISCAL EFFECT: According to the Assembly Appropriations Committee:
Potential revenue loss to affected boards attributable to lower average initial licensure fees in the range of hundreds of thousands of dollars annually (various special funds). This may increase pressure on boards to raise fees. However, in some cases, fees are already set at their statutory maximums.
Minor and absorbable costs to affected licensing boards associated with changing cashiering procedures, forms and materials (various special funds).
$120,000 in Information Technology expenditures due to licensing system modifications. (various special funds).
COMMENTS:
[This bill] makes a common-sense change to a policy that can adversely affect young professionals who are just starting out in their careers.”
Background. Many of the boards within the Department of Consumer Affairs (DCA) have implemented a birth date renewal program to calculate license expiration dates. Under the program, a license expires on the licensee's birth date or on the last day of the licensee's birth month on the second year of a two-year renewal term.
For many boards, licensees submit applications for licensure at the same time (e.g. because of the timing of exams). This causes boards to have a large number of applications for initial licenses during peak times. As a result, rather than renew on the date the license was issued, many boards renew licenses based on birth date, which helps prevent the boards from processing large numbers of applications or renewals at one time.
Existing License Fee Pro Rata Formulas. Currently, there are three boards that use an initial license fee pro rata formula. The California Board of Psychology (BOP) and the Veterinary Medical Board (VMB) are required by statute to establish a birth date renewal program that includes a pro rata formula for the payment of fees. The California Architects Board (CAB) voluntarily established a pro rata formula through regulation.
The VMB uses a yearly pro rata formula. For a license that is valid for less than one year, a licensee pays half the initial license fee. For a license that is valid between one to two years, a licensee pays the full fee.
The CAB has used a formula for an initial license that pro rates fees on a monthly basis. According to the CAB, its pro rata formula has been in place for over a decade and continues to operate well. While there are boards that currently use pro rata formulas, this bill would create a consistent system for all the boards.
Implementation Issue:
The DCA anticipates that implementing pro rata formulas will have an impact on BreEZe, the new information technology program created to assist regulatory boards in licensing and other pertinent functions. However, the DCA is unsure of what the impact will be and it is currently looking into the issue.

SUMMARY:
This bill requires the initial license fee for the following licensing categories to be prorated on a monthly basis: dentists, dental hygienists, physicians and surgeons, hearing aid dispensers, occupational therapists, physical therapists, veterinary technicians, veterinarians, acupuncturists, and architects.
FISCAL EFFECT:
Revenue loss to affected boards attributable to lower average initial licensure fees of at least several hundred thousand dollars annually (various special funds). This may increase pressure on boards to raise fees. However, in some cases, fees are already set at their statutory maximums.
Minor and absorbable costs to affected licensing boards associated with changing cashiering procedures, forms and materials (various special funds).
$140,000 in Information Technology expenditures due to licensing system modifications. (various special funds).
COMMENTS:
Purpose. This bill requires initial licensing fees for specified healing arts practitioners and architects to be prorated on a monthly basis, to ensure that licensees are charged fees in a fair manner and are not disadvantaged based on their birth month. This bill is author-sponsored.
Birth Date Renewal Program. Many boards and bureaus under Department of Consumer Affairs (DCA) operate a birth date renewal program. Instead of basing license renewals on the date of issuance of the initial license, which would result in the boards facing the same influx of applications year after year, most boards renew licenses based on birth date, rather than the date the license was issued, which allows the boards to spread out that work throughout the year.
Related Legislation. AB 773 (Baker), pending on the Assembly Floor, makes psychologist's initial licensure for a 2-year period, with expiration based on licensure date instead of birthdate.
Previous Legislation.
AB 1758 (Patterson) of 2014 as introduced was similar to this bill. AB 1758 was amended in this committee to address concerns related to mismatch of initial licensure workload and revenue, and was ultimately held in Senate Appropriations Committee.
SB 2014 (Machado) of 2002 directed the MBC to prorate its annual licensing fees in cases where the initial licensure period is less than two years, and deleted an obsolete oral examination fee authority. That bill was held in the Senate Appropriations Committee.
SB 1045 (Murray) of 2000 would have directed the MBC to prorate its annual licensing fees in cases where the initial licensure period is less than two years. That bill was held in the Senate.
SB 663 (Maddy), Chapter 626, Statutes of 1992, authorized the Veterinary Medical Board (VMB) to adopt regulations for the waiver or refund of initial registration fees if the registration is issued less than 45 days before it will expire.
Staff Comments. As currently drafted, this bill may result in a mismatch between fees and workload. The fee for initial licensure must support initial licensure workload, such as initial verification of education and experience, as well as ongoing oversight workload for the period of the license. Some level of proration appears reasonable, but in some cases where the initial licensures will only be in effect for a short period of time, fees prorated on a monthly basis may not be adequate to cover the workload costs of initial licensure. Initial licensure requires a set amount of workload regardless of the length of the license. The Medical Board for example, charges an application fee in addition to initial licensure fee to cover the costs of establishing a license. Initial licensure and/or application fees should be adequate to cover the cost of establishing a license. The author may wish to ensure that is the case for each board when moving to a prorated system.

For many boards, licensees submit applications for licensure at the same time (e.g. because of the timing of exams).
The California Board of Psychology (BOP) and the VMB are required by statute to establish a birth date renewal program that includes a pro rata formula for the payment of fees. The CAB voluntarily established a pro rata formula through regulation.
The BOP was initially included in this bill but requested to be excluded from this bill because AB 773 (Baker), of this legislative session, would revise the licensure renewal program for psychologists to a two-year renewal program based on application date.
Current Related Legislation. AB 773 (Baker) of the current legislative session, will change the expiration date of a psychologist's license from the licensee's birthdate to two-years after the date of issuance. STATUS: This bill is pending in the Assembly Appropriations Committee.
Prior Related Legislation. AB 1758 (Patterson), would have required that the fee for an initial temporary or permanent license or an original license be prorated on a monthly basis. It was amended in appropriations to authorize a board or committee to impose an additional fee to cover the reasonable costs of issuing an initial or original license that expires in less than 12 months. NOTE: This bill was held in the Senate Appropriations Committee.
ARGUMENTS IN SUPPORT:
The California Physical Therapy Association writes in support, “By charging licensees a pro-rated amount of the licensure fee based on how many month have elapsed between initial license issuance and their birth date renewal, AB 483 will even the playing field for licensees in professions that must comply with the birth month renewal policy.”
The Fresno Chamber of Commerce writes in support, “The [BPC] links license renewals for numerous professions… to birth dates instead of license issuance dates. For many professionals, their license may expire only a few months after they first receive it, forcing them to spend hundreds of extra dollars.”
ARGUMENTS IN OPPOSITION:
None on file.
